Mean annual serious injury and mortality in the MABT fishery were 179.81 (CV=0.14) shortbeaked common dolphins, 38.28 (CV=0.28) Risso's dolphins, 15.71 (CV=0.42) offshore common bottlenose dolphins, 28.06 (CV=0.39) gray seals, and 11.40 (CV=0.40) harbor seals. Mean annual serious injury and mortality estimates for 8 species described in this report are below their respective potential biological removal (PBR) levels. The 2 exceptions are gray and harp seals that have unknown PBRs. There was evidence of acoustic deterrent devices being used on bottom trawl gear primarily in the MABT fishery, resulting in higher bycatch rates for offshore bottlenose dolphin and Risso's dolphins when pingers were used. Observer reports show no evidence of continued use of pingers on bottom trawl gear since 2012. However, uncertainty exists on the use of pingers and their effect on bottom trawl bycatch rates given nonsystematic data collection by fisheries observers on pinger usage in NEBT and MABT fisheries in the Northwest Atlantic region. The 2015 total serious injuries and mortalities in the MAG fishery were 33 (CV = 1.16) harbor porpoises, 30 (CV= 0.55) short-beaked common dolphins, 15 (CV = 1.04) gray seals, and 48 (CV = 0.52) harbor seals. The MAG estimates are based on observed bycatch consisting of 2 harbor porpoises, 3 short-beaked common dolphins, 1 gray seal, and 5 harbor seals. Compliance with the 2010 Harbor Porpoise Take Reduction Plan pinger regulations was 86% in 2015, where compliance refers to the correct number of pingers used, not the pingers' functionalit y. Compliance rates in the 2015 MAG fishery were low for large mesh gillnets (55%) and relatively high for small mesh gillnets (87%).

Book excerpt: Cetacean populations are confronted by many anthropogenic threats, including commercial whaling, noise, vessel collisions, gear entanglement, exploitative competition, habitat disturbance, and global climate change. Evidence indicates that commercial fishing activities can have both direct (e.g., gear entanglement and bycatch) and indirect (e.g., prey reduction and noise) effects on cetaceans. However, few studies have addressed the potential vulnerability of a given cetacean species to an entire fishing fleet that operates over a large marine ecosystem. In this study, we overlaid spatially explicit multiyear predicted mean densities of 11 cetacean species and 1 species guild within the California Current Large Marine Ecosystem with data for commercial fishing effort of the fixed-gear, at-sea hake mid-water trawl, and bottom trawl fleets of the west coast groundfish fishery. We quantified the exposure of each species to each fleet type by multiplying the predicted mean cetacean density by the measured fishing fleet effort. We found large interspecific and interfleet variability in the overlap between cetaceans and fishing fleets. Although many of the species had relatively low overlap rates, others had substantial exposure to some of the fishing fleets, particularly those species with more nearshore distributions. Direct mortality from these fleets has been documented to be low, but our results indicate that there is opportunity for fisheries interactions with some cetacean species, particularly in the fixed-gear fleet. Our analyses make up an important first step in generating formal risk assessments for quantification of the impacts of various fishing fleets on populations of cetacean species that occur in the California Current.

Serious injury (SI) determinations were addressed at NMFS-convened workshops in 1997 and 2007 (Angliss and DeMaster 1998; Andersen et al. 2008), and in January 2012 the agency published new national guidelines for distinguishing serious from nonserious injuries of marine mammals (http://www.nmfs.noaa.gov/pr/pdfs/serious_injury_procedure.pdf). A major goal of the new guidelines was to establish national consistency and transparency in SI determinations. To implement the new guidelines, Science Center SI determination staff (SID) are required to annually review the observer (OBS) and at-sea monitor (ASM) records on all incidentally caught marine mammals that were released alive. Book excerpt: "As part of the AMAPPS (Atlantic Marine Assessment Program for Protected Species) project, the Northeast Fisheries Science Center (NEFSC) and Southeast Fisheries Science Center (SEFSC) of NOAA Fisheries Service conducted line-transect aerial and shipboard abundance surveys to estimate the abundance of cetaceans and sea turtles in the northwestern Atlantic Ocean during Jun - Aug 2011. This manuscript focuses on abundance estimates of cetaceans detected during the NEFSC surveys that covered waters from North Carolina to the lower Bay of Fundy, from the shore to the Gulf Stream, which is about 370 km (200 nmi) offshore. In a study area of about 463,000 km2, over 9100 km of track lines were covered. To estimate abundance the two-independent team data-collection method and the mark-recapture distance sampling (MRDS) and multiple covariate distance sampling (MCDS) analysis methods were used. Overall, approximately 342,000 cetaceans of 18 species were estimated to be present in the study area. Species specific abundance estimates for the surveyed area range from 300 - 400 sei whales (Balaenoptera borealis) and humpback whales (Megaptera novaeangliae) each, to over 40,000 animals per species of harbor porpoises (Phocoena phocoena), Atlantic white-sided dolphins (Lagenorhynchus acutus), striped dolphins (Stenella coeruleoalba) and short-beaked common dolphins (Delphinus delphis). Book excerpt: "The Marine Mammal Protection Act (MMPA) requires the National Marine Fisheries Service NMFS to estimate annual levels of human-caused mortality and serious injury to marine mammal stocks (section 117) and to categorize commercial fisheries based on their level of incidental mortality and serious injury of marine mammals (section 118). Serious injury (SI) determinations were addressed at NMFS - convened workshops in 1997 and 2007 (Angliss and DeMaster 1998; Andersen et al. 2008), and in January 2012 the agency published new national guidelines for distinguishing serious from nonserious injuries of marine mammals (http://www.nmfs.noaa.gov/pr/pdfs/serious_injury_procedure.pdf ). A major goal of the new guidelines was to establish national consistency and transparency in SI determinations. To implement the new guidelines, Science Center SI determination staff (SID) were required to review the 5-year (2007 - 2011) observer (OBS) and at sea monitor (ASM) records on all incidentally caught marine mammals that were released alive. Observer comments on the condition of released animals were compared by taxonomic group (e.g., large whales, small cetaceans, and pinnipeds) to specific injury categories described in the procedure manual. Based on these reviews, each animal was assigned an injury determination. Once completed, the SI determination table was independently reviewed by another center's SID (e.g., Northeast Fisheries Science Center [NEFSC] determinations were sent to Southwest Fisheries Science Center [SWFSC]), and differences are subsequently revisited. The revised determinations were subsequently reviewed by regional Scientific Review Groups (SRG) at their annual meeting, and final determinations are published"--Introduction.

Observer comments on the condition of released animals and any associated photographs were compared to specific injury categories described in the new guidelines' procedure manual, and each event was assigned an injury determination. Once completed, the Northeast Fisheries Science Center (N EFSC) SI small cetacean and pinniped determination table was independently reviewed by the Southwest Fisheries Science Center's ( SWFSC ) SID staff, the Greater Atlantic Regional Fisheries Office (GARFO), and the Atlantic Scientific Review Group (SRG) before the SI determinations were finalized"--Introduction.
