The first two chapters study flat fee compensation structures for publicly financed defense lawyers, their implications for case outcomes of indigent defendants and lawyer effort, and their role in distorting incentives away from effective legal representation in the spirit of the Sixth Amendment. The third chapter examines whether pre-arrest diversion programs impact later-life outcomes, such as recidivism, among first-time misdemeanor offenders. In Chapter 1, I empirically examine whether compensation structures for court-appointed attorneys impact case outcomes of indigent defendants. I study this question in the context of a natural experiment in North Carolina, in which six counties were arbitrarily chosen to change compensation for assigned counsel from a schedule of statewide hourly rates to a flat fee per case disposed. Linking detailed administrative on attorney pay records with court records for the universe of indigent criminal cases in the state, I find that moving from hourly to flat fee pay resulted in a higher incidence of adverse case outcomes: defendants were 11% more likely to be convicted and 37% more likely to be incarcerated, a result driven by an increase in guilty pleas. In Chapter 2, I investigate two potential mechanisms through which compensation structures for court-appointed attorneys may impact case outcomes of indigent defendants. Examining the intensive margin response on effort, I find evidence that lawyers reduce their effort under flat fee pay: lawyers spend 11% fewer hours on each case, dispose of cases 25% sooner, and are 36% more likely to dispose of a case on the same day as their first meeting with the defendant. Second, I examine selection of lawyers on the extensive margin, but do not find evidence that moving to flat fee pay significantly impacted lawyer composition in the treated counties. In Chapter 3, I turn my attention to the long-term impacts of criminal records, which can create barriers to employment, housing, and higher education throughout an individual's life. I focus on the pre-arrest misdemeanor diversion program (MDP) in Durham County, NC, which has been offered to first-time offenders from 2014 to the present day. Key features of the program include rehabilitative treatment (such as mental health counseling) in lieu of arrest and prosecution, a clean criminal record for participants upon successful completion, and law enforcement officer discretion in diverting first time offenders as an alternative to arrest. I propose two empirical strategies to study the impact of pre-arrest diversion on later-life outcomes, particularly future criminal behavior, of first-time offenders. First, I propose a regression discontinuity approach that exploits cutoffs at (1) the start of the program in March 2014 for 16-17 year old offenders and (2) an expansion of the program to 18-21 year old offenders in October 2015. All rights not granted by the above license are retained by the author. Abstract: This thesis consists of two essays exploring the effects of executive compensation contracts on the real economy. Evidence from equity incentive schemes and annual bonus plans are provided separately in the two essays. The first essay examines the relation between CEO option compensation and bank risk-taking, and the role of CEO option compensation in affecting bank performance during the 2007-2008 financial crisis. Through panel regressions, I find that over the sample period (1993-2011), option awards received by bank CEO and CEO option holdings lead to higher bank risk which is not rewarded by better performance. Bank CEOs take more risk by engaging more in financial innovation and maintaining more risky loan portfolios. Institutional investors favor high option compensation in their own interests of pursuing short-term stock price upswing, while a larger board corrects this excessive risk-taking by providing bank CEOs with less option compensation. Cross-sectional evidence shows that during the crisis period, the effect of option compensation in increasing risk-taking and worsening performance comes from exercisable option holdings. In addition to the findings regarding option compensation, stock awards are shown to affect bank risk and performance, while stock holdings play no role. In the second essay, using a hand collected sample of 1491 firm-years spanning 2006-2011, for which I have been able to gather from annual incentive schemes performance measures and two levels of corresponding targets which represent board directors' performance expectations on chief executive officers (CEOs), I discover that the probability of CEO turnover significantly increases when a firm fails to meet its performance targets, and the likelihood of CEO replacement becomes even higher when minimum performance targets are missed. In a horse race of various financial measures used, failure to meet earnings targets most significantly increases the likelihood of CEO dismissal, and cash flow matters most when minimum targets are considered. Further, the effect varies with firm characteristics in that failing to meet revenue targets lead to turnover only in growth firms, while only in distressed firms CEOs are more likely to lose the job because of missing cash flow targets. The first essay, "Does Incentive Pay Alter Physician Effort? An Analysis of the Time and Treatment that Physicians Provide to Patients," examines the link between incentive pay and effort among a group of highly-skilled workers: physicians. The other two essays, "Exiting TANF in South Carolina after the Deficit Reduction Act" and "What Happened to Cash Assistance for Needy Families," focus on a group of generally low-skilled, low-wage workers: welfare recipients. "Exiting TANF in South Carolina after the Deficit Reduction Act " examines the impact of a recent welfare reform aimed at promoting employment and self-sufficiency on durations of welfare recipiency. "What Happened to Cash Assistance for Needy Families?" identifies trends in welfare recipiency and self-sufficiency over the past twenty years. While a number of studies have attempted to measure the impact of financial incentives on physician behavior, none has examined the impact of performance-based incentive pay on broad measures of physician effort. In "Does Incentive Pay Alter Physician Effort? An Analysis of the Time and Treatment that Physicians Provide to Patients." I use newly available data from the National Ambulatory Medical Care Survey from 2006 through 2008 to estimate the effect of three specific types of performance-based incentive pay -- productivity incentives, patient-centered incentives, and practice profiling incentives -- on both the time physicians spend with patients and the intensity with which physicians treat patients. Using a discrete factor approximation approach to control for the endogeneity of incentive pay, I am able to estimate the impact of these types of incentive pay on physician effort. I find that performance-based incentive pay is associated with physicians spending significantly less time with each patient. I also find some evidence that performance-based incentive pay impacts physicians' intensity of treatment. The Deficit Reduction Act of 2005 (DRA) narrowed and standardized the work and work readiness activities that satisfy the work requirement of the Temporary Assistance for Needy Families (TANF) program. In "Exiting TANF in South Carolina after the Deficit Reduction Act, " I use administrative data from South Carolina's TANF program and employ event history techniques with a difference-in-difference estimation framework to analyze the effect of this policy change. I find that the DRA's definition of work and work readiness activities reduced the likelihood of black recipients to exit the TANF program in South Carolina while increasing the likelihood of exit for non-black recipients. For blacks, this decrease in the hazard comes from a decrease in the likelihood of exit through employment. For non-blacks, the result stems from an increase in the hazards for administrative exits and for other income exits. I also find that the reform led to longer durations of TANF benefit receipt in South Carolina for black recipients and shorter durations of cash assistance for non-black recipients. A primary goal of welfare reform since the early 1990's has been to increase the self-sufficiency of welfare recipients. The essay "What Happened to Cash Assistance for Needy Families?, " coauthored with David. C. Ribar, examines trends in the characteristics and outcomes for recipient families to determine if welfare recipients are becoming more self-sufficient. Using annual public use data on AFDC and TANF households from the Department of Health and Human Services, we find both positive and negative trends over the past twenty years. We find that the size of the caseload has decreased, the fraction of the caseload with earned income has increased, and the average earnings of welfare recipients has increased. On the other hand, we find that the fraction of child-only cases has increased, the caseload has disproportionately dropped the least-skilled households, average benefits fell faster than earnings grew, and the majority of households that exit TANF have no earnings."--Abstract from author supplied metadata.

In the first chapter, the impact of political sensitivity is investigated as an external force on government contractor executive compensation. Compensation for top executives has come into the political spotlight, especially over the last decade, with many politicians publicly supporting limits on compensation. However, the impact of political scrutiny to limit compensation is debatable. This study analyzes the effect of political scrutiny on CEO compensation using a sample of Federal contractors, which represents a group of firms where politicians yield the most power. Results suggest that Federal contractors with the most visible government contracts that make up significant portions of their revenue have lower CEO compensation, but the efficiency of this compensation structure is debatable as it leaves CEOs with weaker incentives. However, the impact of political sensitivity is muted when the firm has more bargaining power with the government. In the second chapter, the effects of external forces of mandated compensation disclosure and shareholding voting requirements on compensation behavior are examined. Given the lack of guidelines provided for Dodd-Frank mandated Pay for Performance disclosure and the increase in alternative pay definitions used in Pay for Performance discussions, this chapter analyzes the determinants of and the effects on Say on Pay support of disclosing alternative pay measures. Results suggest that firms that disclose alternative pay measures in their Pay for Performance discussions do so for different reasons. Although certain measures are characteristic of opportunistic disclosure and others are indicative of informative disclosure, effects on Say on Pay are similar yet distinct. There is often a significant positive impact of disclosing additional information related to compensation on Say on Pay approval, particularly when combating prior poor Say on Pay support. However, the positive impact on Say on Pay support is most robust when peer comparisons are shared, providing evidence of the value of reporting comparative pay.

Prior literature suggests three explanations for why companies are granting stock options as a form of compensation to non-executive employees. Broad-based option grants can be used as an incentives tool, a sorting mechanism, and a means of assisting with employee retention. An alternative explanation also exists, namely, that financially constrained firms use broad-based option grants as a form of self-financing. This dissertation contributes to existing literature by examining the financial-constraints hypothesis in firms' option-granting practices. It is the first study to combine two independent approaches in testing the financial-constraints hypothesis in firm-wide option grants. Using simulated and empirical returns in utility model for a representative individual employee, I investigate whether option-based substitutions for a portion of payment in cash can result in economic savings to firms. Secondly, using empirical data on broad-based option grants and utilizing a financial constraints index and individual variable proxies for constraints, I examine the relationship between option grants and the severity of financial constraints to which the firm is subject. I find that direct financial benefits to the firm from the use of option grants are, in general, possible. However, sorting is more likely primary reason for using broad-based option grants, while self-financing is a positive side effect of sorting. Essay II. Agency problems are generally viewed in the literature as one of the reasons why the diversification discount exists. The adoption of equity-based forms of pay (EBC) in CEOs' compensation is considered one way of mitigating agency problems and thus enhancing the value of the firm. Essay II investigates how the intensity of EBC impacts the valuation of diversified firms in two dimensions of diversification: industrial and geographic. Building on the prior literature, this study takes a multi-dimensional approach by considering the combined effects of EBC levels, degrees of product, and geographic diversification on the valuation of the firm. Based on the results of this study I conclude that a firm's valuation is negatively affected by geographic diversification, but it is positively related to industrial diversification, while firms pursuing dual diversification strategies are valued at a discount. Use of the EBC helps to mitigate agency problems and has a positive effect on the firm's valuation. Finally, as a secondary objective I investigate whether regulatory changes (adoption of the SFAS No. 131, FASB 1997) affect the nature of the reported segment data. I find that new regulations do not materially alter the nature of the reported segment data, at least for the purposes of this study.
