Available in PDF, EPUB and Kindle. Book excerpt: This book examines the prospects for business law reform to drive economic development in developing countries. It argues that, despite statements to the contrary, cultural factors and other local conditions in developing countries are not properly taken into account in current business law reform programs. Utilizing the city of Dakar as an example, this book investigates the consequences of this lack of fit between local needs and transplanted legal models by examining the potential and actual impact of the OHADA program of law reform on local business practices. Focusing on how managers make decisions and apply appropriate norms in routine business operations, the book documents how contractual disputes arise and are solved in Dakar and the role played by formal law in these processes. By examining imported law from the point of view of the end-users of legal reforms, the book reveals the complex relationship between formal law, local cultural norms and the activities of SMEs operating in developing economies, and calls for a reconsideration of current law and development theory as well as the role of contract law in business decisions. It will be relevant to all developing countries seeking to align their laws with ’best practice’ as identified by aid institutions.

Book excerpt: This volume presents a wide selection of studies on the issues of law, land dispute and conflict (mediation) in Africa, reconsidering the role of state agents and other actors in these matters. The focus is on analyzing how citizens, state institutions and concerned (inter)national actors aim to find solutions to disputes, tension and conflict that are part of social life. The authors have approached the subject of Land, Law and Politics in Africa from a variety of disciplinary angles. The issues at stake comprise land access and land use, state politics and democratization efforts, the relationship between constitutional/state law and customary law, the challenges of urban and rural conflicts, border issues and the conceptions of (human) rights. On the basis of new empirical studies, the authors plead for a more holistic perspective on the above issues and on developmental policy in general. The book has 15 chapters in four thematic parts, focusing on historical and cultural aspects of politics and authority; land law and land disputes; constitutionalism and politics; and conflict studies. The volume is also a tribute to the work of Gerti Hesseling (1946-2009), a Dutch Africanist with a successful career as a scholar of constitutional and land law, focusing on West Africa.

Book excerpt: At specific moments in the history of Africa, Europe, and Latin America, each region decided to create supranational jurisdictions to protect human rights. These are, in chronological order, the European Court of Human Rights, the Inter-American Court of Human Rights, and the African Court on Human and Peoples' Rights. While each has been the subject of important, dedicated monographs, no major study has analysed both the institutional and jurisprudential issues of all three regional systems. The 3 Regional Human Rights Courts in Context: Justice That Cannot Be Taken for Granted is the first book to offer a comprehensive comparison of the three systems. Rather than merely juxtaposing analogous features, the book considers how the three courts operate as parts of a greater, integrated whole. Similarities and differences between the courts are illuminated alongside historical, political, and sociological insights, in addition to the book's primary legal focus. Close analysis of the processes by which the courts came into being makes it clear that, regardless of distinct political, cultural, or other variances, states on each of the three continents have chafed against international supervision. The book also debunks the common belief that, after the Second World War, the thrust of human rights initiatives was so powerful that states no longer need to discuss them. Justice cannot be taken for granted—a position further supported by the book's analysis of how each court has evolved and how their rulings have been implemented. Laurence Burgorgue-Larsen's dynamism and multidisciplinary approach makes it possible to truly understand the stakes behind the institutional and jurisprudential developments of the three regional human rights courts. This is a book that will interest not only legal practitioners but also specialists in international relations, human rights, and countless other fields.

Available in PDF, EPUB and Kindle. Book excerpt: An ethnographic study of issues of land rights, property regimes, and ethnicity in West Africa. Focusing on an area of the savannah in northern Ghana and southwestern Burkina Faso, Land, Mobility, and Belonging in West Africa explores how rural populations have secured, contested, and negotiated access to land and how they have organized their communities despite being constantly on the move as farmers or migrant laborers. Carola Lentz seeks to understand how those who claim native status hold sway over others who are perceived to have come later. As conflicts over land, agriculture, and labor have multiplied in Africa, Lentz shows how politics and power play decisive roles in determining access to scarce resources and in changing notions of who belongs and who is a stranger. “Illuminates the distinctive historical trajectory of land claims, authority, and belonging among the Dagara and Sisala peoples of the Black Volta region, and locates this specific case history within broader debates over transformation in access, use, and control over land in colonial and postcolonial Africa.” —Sara Berry, Johns Hopkins University “Important in the sense that it constitutes a detailed historical study of how complex narratives of belonging and notions of property interlock. . . . It is academic work of the first order.” —Christian Lund, Roskilde University

Book excerpt: Founded in 1993, the African Yearbook, now published under the auspices of the African Foundation for International Law, is the only scholarly publication devoted exclusively to the study, development, dissemination and wider appreciation of international law in Africa as a whole. Through the scholarly analysis of international legal issues of particular relevance to the African continent, it also contributes to the acceptance of, and respect for the rule of law in intra-African relations, and for the principles of international law in general. Its uniqueness however goes beyond this, for through its special themes and general articles, it has succeeded over the years to serve as an intellectual forum where the development of international law is viewed as being integral to Africa's own development. Through the study and analysis of emerging legal issues of particular relevance to Africa, such as the creation of viable continental institutions capable of promoting unity and security for the peoples of the continent, the effective protection of human rights, the need for accountability for mass killings and massive violations of the rule of law, the promotion of a rule-based democratic culture, the role of African countries in a globalizing world economy and in international trade relations, the Yearbook strives to be responsive to the intellectual needs of African countries in the area of international law, andtothe continuing struggle for creating an environment conducive to the rule of law throughout the continent. The Yearbook also provides ready access to the basic documents of African international organizations by regularly publishing the resolutions and decisions ofregional and sub-regional organizations as well as the conventions, protocols and declarations adopted by pan-african agencies.
