Com a ascensão vertiginosa do Direito Constitucional como disciplina jurídica após a edição da Carta de 1988 e a relevância institucional contemporânea do STF, o ativismo judicial tem sido considerado um tema da moda. Tendo pesquisado bastante sobre o assunto, escrevi alguns artigos sobre a matéria, que agora compõem a primeira parte desta coletânea. A segunda parte é dedicada a textos sobre questões tributárias, algumas ainda pendentes de solução definitiva pelo STF, como no caso do ICMS na base de cálculo do PIS e da Cofins. Abordo também a problemática da guerra fiscal do ICMS, questão tormentosa de nosso federalismo fiscal. O texto mais longo envolve minha visão sobre a interpretação tributária, em especial a interpretação constitucional tributária realizada pelo STF. Por fim, faço uma homenagem aos três principais professores de Financeiro e Tributário da UERJ, problematizando o tema da anualidade tributária.

This book is the culmination of nearly six years of research initiated by Fred Cate and Jim Dempsey to examine national practices and laws regarding systematic government access to personal information held by private-sector companies. Leading an effort sponsored by The Privacy Projects, they commissioned a series of country reports, asking national experts to uncover what they could about government demands on telecommunications providers and other private-sector companies to disclose bulk information about their customers. Their initial research found disturbing indications of systematic access in countries around the world. These data collection programs, often undertaken in the name of national security, were cloaked in secrecy and largely immune from oversight, posing serious threats to personal privacy. After the Snowden leaks confirmed these initial findings, the project morphed into something more ambitious: an effort to explore what should be the rules for government access to private-sector data, and how companies should respond to government demands for access. This book contains twelve updated country reports plus eleven analytic chapters that present descriptive and normative frameworks for assessing national surveillance laws, survey evolving international law and human rights principles applicable to government surveillance, and describe oversight mechanisms. It also explores the concept of accountability and the role of encryption in shaping the surveillance debate. Cate and Dempsey conclude by offering recommendations for both governments and industry.

Book excerpt: This title offers a unique approach to constitutionalism, focusing on the paradoxical relationship between principles and rules from the perspective of systems theory. It presents a critical counterpoint to Ronald Dworkin's principle-based theory, and in particular to Robert Alexy's idea of optimizing balancing. Instead of ceding to the compulsion of an optimizing balancing, it suggests the possibility of a comparative or at least 'satisficing' balancing, considering the precariousness of legal rationality. The book also reverses Dworkin's metaphor, associating rules with Hercules and principles with the Hydra. It takes constitutional principles seriously, criticizing the abuse of principles by the legal and constitutional doctrine and practice, and pointing out their relationship of complementarity and tension with rules. Finally, it offers an alternative model to the recent legal and constitutional theory on the basis of certain assumptions of the systems theory. It deals especially with the paradox of the circular and reflexive relationship between constitutional principles and rules: the former refers primarily to the openness and adequacy of legal system to society and thus to substantive argumentation; the second refers primarily to the closure and consistency of legal system and thus to formal argumentation.
