Book excerpt: In response to a congressional request, GAO assessed the Environmental Protection Agency's (EPA) authority to negotiate voluntary agreements with the chemical industry to perform tests on the health and environmental effects of chemical substances, in lieu of issuing administrative rules to require such testing pursuant to the Toxic Substances Control Act. GAO also identified whether opportunities were provided under this approach for public participation. GAO believes that EPA may negotiate voluntary testing agreements and, in appropriate instances, accept them in lieu of the act's test rules. EPA officials feel that voluntary negotiated testing agreements outside of the formal rulemaking process reduce the time it takes to obtain data on health and environmental effects. They stated that developing a negotiated agreement would require fewer EPA resources than acquiring the same data through a formal rule; in addition, a negotiated agreement lends itself to a cooperative, rather than an adversarial, relationship among all parties. EPA takes the position that issuance of a test rule to require health and environmental effects testing by manufacturers is not necessary under the act when voluntary testing by the manufacturers either has been agreed to or is ongoing. GAO believes that the EPA interpretation of its authority to negotiate agreements with industry for the voluntary testing of priority chemical substances is reasonable. A major shortcoming of the negotiated testing agreement is that it is not enforceable. However, EPA can issue a test rule if an agreement is not lived up to. The negotiated testing process, as described by EPA, provides the opportunity for the public to review and comment on proposed EPA actions at four different points of the process.

GAO noted that: (1) because of high legal standards, EPA has issued regulations to control only nine chemicals since the enactment of TSCA; (2) extensive use of TSCA is not likely as long as EPA gives preference to other environmental laws that provide limits on emissions rather than restrictions on production; (3) TSCA chemical information-gathering and control authorities are difficult to use and ineffective; (4) EPA has assessed the risks of only about 2 percent of the chemicals in use; (5) EPA review processes do not ensure that the potential risks of new chemicals are fully assessed before they enter commerce; (6) EPA may not be able to improve its chemical review and control procedures without shifting more of the burden to the chemical industry; (7) much of the information on chemicals cannot be disseminated by EPA because it is confidential; and (8) although EPA has successfully challenged the validity of some confidentiality claims, it does not have the resources to challenge a significant portion of claims.

At that time, EPA also initiated a new approach for managing toxic chemicals using its existing TSCA authorities. This testimony summarizes GAO's past work describing: (1) challenges EPA has faced historically in regulating chemicals and (2) the extent to which EPA has made progress implementing its new approach, and challenges, if any, which persist. This statement is based on GAO reports issued between 1994 and 2013. GAO is not making new recommendations in this testimony. In prior reports, GAO suggested that Congress consider statutory changes to TSCA to give EPA additional authorities to obtain information from the chemical industry and shift more of the burden to chemical companies for demonstrating the safety of their chemicals. In these reports, among other things, GAO recommended that EPA require companies to provide chemical data they submitted to foreign governments, require companies to reassert confidentiality claims, and develop strategies for addressing"
