While traditional development strategies aim for maximum economic growth, new approaches emphasize conservation. The governing of land use is also central to the overall scheme of national governance - the constitution. This book examines the relationship between land ownership and the conservation of natural resources, using the case of Kenya. It proposes specific measures for achieving a balance between private ownership and public interest, and between conservation and economic growth"--Publisher's description.

Book excerpt: Kenya is one of about 42 African countries which have enacted framework environmental laws. 14 January 2000 was the Date of Commencement of the Environment Management and Co-ordination Act (EMCA) after its adoption in December 1999 and receipt of Presidential Assent on 6 January 2000. From that date, all sectoral laws were expected to be reviewed or amended to ensure consistency with the requirements of EMCA. Under Section 148 of EMCA: "Any written law, in force immediately before the coming into force of this Act, relating to the management of the environment shall have effect subject to modification as may be necessary to give effect to this Act, and where the provisions of any such law conflict with any provisions of this Act, the provisions of this Act shall prevail". This book is an appraisal of the extent to which this provision has been implemented. It critically analyses environmental law in Kenya with a view to identifying the convergences and divergences between select sectoral laws and EMCA. The ultimate objective is to support internal harmonization of the corpus of environmental law in Kenya.

Book excerpt: This book brings together original and novel perspectives on major developments in human rights law and the environment in Africa. Focusing on African Union law, the book explores the core concepts and principles, theory and practice, accountability mechanisms and key issues challenging human rights law in the era of global environmental change. It, thus, extend the frontier of understanding in this fundamental area by building on existing scholarship on African human rights law and the protection of the environment, divulging concerns on redressing environmental and human rights protection issues in the context of economic growth and sustainable development. It further offers unique insight into the development, domestication and implementation challenges relating to human rights law and environmental governance in Africa. This long overdue interdisciplinary exploration of human rights law and the environment from an African perspective will be an indispensable reference point for academics, policymakers, practitioners and advocates of international human rights and environmental law in particular and international law, environmental politics and philosophy, and African studies in general. It is clear that there is much to do, study and share on this timely subject in the African context.

Book excerpt: Environmental standards in Kenya are generally much lower than those in Western Europe, though a number of local municipalities have pushed for stronger controls. Many companies, both local and foreign, have taken advantage of the disparity in standards that exist. But research by means of case studies reveals that there are exceptions, notably amongst some European subsidiaries, whose management insist on a high degree of self-control whatever the state of the local legislation. The new Environmental Management and Coordination Act is set to change the face of Kenyan environmental law, and its strengths and weaknesses are assessed. Public awareness of the need for environmental protection will be critical to the success of the legislation, and there are some signs of positive change.

Book excerpt: Reflecting a global trend, scores of countries have affirmed that their citizens are entitled to healthy air, water, and land and that their constitution should guarantee certain environmental rights. This book examines the increasing recognition that the environment is a proper subject for protection in constitutional texts and for vindication by constitutional courts. This phenomenon, which the authors call environmental constitutionalism, represents the confluence of constitutional law, international law, human rights, and environmental law. National apex and constitutional courts are exhibiting a growing interest in environmental rights, and as courts become more aware of what their peers are doing, this momentum is likely to increase. This book explains why such provisions came into being, how they are expressed, and the extent to which they have been, and might be, enforced judicially. It is a singular resource for evaluating the content of and hope for constitutional environmental rights.

It is a vast area of law that operates from the local to the global, involving a range of different legal and regulatory techniques. In theory, environmental protection is a no brainer. Few people would actively argue for pollution or environmental destruction. Ensuring a clean environment is ethically desirable, and also sensible from a purely self-interested perspective. Yet, in practice, environmental law is a messy and complex business fraught with conflict. Whilst environmental law is often characterized in overly simplistic terms, with a law being seen as be a magic wand that solves an environmental problem, the reality is that creating and maintaining a body of laws to address and avoid problems is not easy, and involves legislators, courts, regulators and communities. This Very Short Introduction provides an overview of the main features of environmental law, and discusses how environmental law deals with multiple interests, socio-political conflicts, and the limits of knowledge about the environment. Showing how interdependent societies across the world have developed robust and legitimate bodies of law to address environmental problems, Elizabeth Fisher discusses some of the major issues involved in environmental law's: nation statehood, power, the reframing role of law, the need to ensure real environmental improvements, and environmental justice. As Fisher explains, environmental law is, and will always be, necessary but inherently controversial. ABOUT THE SERIES: The Very Short Introductions series from Oxford University Press contains hundreds of titles in almost every subject area. These pocket-sized books are the perfect way to get ahead in a new subject quickly. Our expert authors combine facts, analysis, perspective, new ideas, and enthusiasm to make interesting and challenging topics highly readable.

Book excerpt: As wildfires rage, pollution thickens, and species disappear, the world confronts environmental crisis with a set of global institutions in urgent need of reform. Yet, these institutions have proved frustratingly resistant to change. Introducing the concept of Temporal Focal Points, Manulak shows how change occurs in world politics. By re-envisioning the role of timing and temporality in social relations, his analysis presents a new approach to understanding transformative phases in international cooperation. We may now be entering such a phase, he argues, and global actors must be ready to realize the opportunities presented. Charting the often colorful and intensely political history of change in global environmental politics, this book sheds new light on the actors and institutions that shape humanity's response to planetary decline. It will be of interest to scholars and advanced students of international relations, international organization and environmental politics and history.
