Book excerpt: This book outlines the procedures used in many Commonwealth countries in key areas of the legislative process, especially on the executive side of government. It also covers the procedures in the legislature and the entry into force of different types of legislation. The jurisdictions discussed include the United Kingdom, Canada, Australia and New Zealand, as well as others in Asia, Africa and the Caribbean. The intention is to assist legislative counsel, politicians and students gain a wider perspective of processes in which drafters, civil servants and politicians participate. In this process, the book also lays bare certain procedures that should now be considered international best practice in the Commonwealth. The book is a follow-up to the author's well-received earlier publication The Legislative Process: A Handbook for Public Officials (2009). However, this book considerably expands on the earlier one in terms of the countries and areas covered, as well as the whole approach to the subject.

Available in PDF, EPUB and Kindle. Book excerpt: This book constitutes the first thorough academic analysis of legislative drafting. By placing the study of legislation and its principles within the paradigm of Flyvberg's phronetic social sciences, it offers a novel approach which breaks the tradition of unimaginative past descriptive reiterations of drafting conventions. Instead of prescribing rules for legislation, it sets out to identify efficacy as the main aim of the actors in the policy, legislative and drafting processes, and effectiveness as the main goal in the drafting of legislation. Through the prism of effectiveness as synonymous with legislative quality, the book explores the stages of the drafting process; guides the reader through structure and sections in their logical sequence, and introduces rules for drafting preliminary, substantive and final provisions. Special provisions, comparative legislative drafting and training for drafters complete this thorough analysis of the drafting of legislation as a tool for regulation. Instead of teaching the reader which drafting rules prevail, the book explores the reasons why drafting rules have come about, thus encouraging readers to understand what goal is served by each rule and how each rule applies. The book is aimed at academics and practitioners who draft or use statutory law in the common or civil law traditions.

Available in PDF, EPUB and Kindle. Book excerpt: People are generally aware that legislation is introduced through Bills that are sent to the legislature, usually by the executive, and then passed into law. Few, however, are familiar with the processes that precede the submission of a Bill to the legislature. In fact, what eventually comes to the legislature is the product of long, often laborious processes, which go on for weeks, months and even years. To ensure that the civil servants and others who may be involved in shaping proposals are able to candidly express their views on policies that are being developed and refined, the deliberations on the executive side of government traditionally take place in secrecy. Mainly for that reason, the processes are not well known to the general public and even to some activists who lobby for or against legislation. This book, written by a lawyer who has long experience participating in these processes, gives rare insight into how legislative proposals are conceived, developed and finally written into the law. It also contains easy-to- understand technical information that explains the significance of certain features of statutes. Further, it deals with other matters that follow after enactment including publication, entry into force, application and much more.

Available in PDF, EPUB and Kindle. Book excerpt: This book outlines the way in which legislative proposals in the British Virgin Islands are conceived and processed. It also contains best practice suggestions on interfacing with Parliamentary Counsel regardless of the jurisdiction in which one is working. Those suggestions are based on the author's well-received earlier publication The Legislative Process: A Handbook for Public Officials (2009). That book was featured significantly in The Parliamentarian: Journal of Commonwealth Parliaments, 2010, Issue 1 XCI. In a review contained in The Loophole: Journal of the Commonwealth Association of Legislative Counsel (August, 2010), the reviewer wrote, "In these times of recession I commend this book to anyone in Government wishing to improve processes to enable the production of legislation with improved efficiency and cost effectiveness." And in the Statute Law Review (April, 2010), 31(2), with reference to its suggestions for improved efficiency, it was said that ". . . there is little that can be described as other than good advice here."

Book excerpt: The world of law has changed in the last decades: it has become more globalized, multilingual and digital. The sections and contributions of this volume continue the interdisciplinary discussion about the challenges of this change for theory and practice of law and for the International Language and Law Association (ILLA) relaunched in 2017. First, the book gives a broad overview to the research field of legal linguistics, its history, research directions and open questions in different parts of the world (United States, Africa, Italy, Spain, Germany, Nordic countries and Russia). The second section consists of contributions about the relation of language, law and justice in a globalized world with a focus on multilingual and supranational law in the EU. The third section focuses on digitalization and mediatization of the law, the last section reports about the discussion at the ILLA relaunch conference in 2017.

Available in PDF, EPUB and Kindle. Book excerpt: This volume brings together an international group of legal scholars to discuss different approaches to lawmaking. As well as reflecting the diversity of legisprudence as a re-emerging academic field, it offers a broad overview of current developments and challenges in the theory of legislation, and aspires, moreover, to counterbalance some questionable ideas or misconceptions, widespread among jurists, on what making laws entails. The book is organized into three parts. The first comprises a sample of ‘ways and models of legislation’, ranging from classic legislative ideals to contemporary forms of regulation. The essays in this part, variances of focus notwithstanding, revolve around the notions of legislative rationality, quality, effectiveness, and legitimacy, which may be regarded as the cornerstones of legisprudence. Interwoven with these notions is another core legisprudential concern: the justification of laws. We address it separately in the next part by exploring the connection between lawmaking, argumentation and constitutional democracy: under the heading ‘legislation in a culture of justification’, a number of aspects of this connection are tackled that have not been sufficiently considered so far in legisprudential literature, such as the intricacies of legislative reasoning and balancing, or the justificatory problems posed by special-interest legislation. The under privileged status of legisprudence in legal studies and the need for socially attentive and citizen-oriented legislative research come to the fore in the third part of the book which turns to the relationships between ‘legisprudence, lawyers, and citizens’. All in all, the thirteen articles gathered here provide a stimulating insight into the theory of legislation, and can hopefully contribute to the reconciliation of the study of law and the study of its making.

Available in PDF, EPUB and Kindle. Book excerpt: The work of HiiL on the law of the future has produced two volumes (The Law of the Future and the Future of Law, Volumes I and II) that bring together 85 think pieces on legal trends in different areas of law and more than 10 interviews with key policy makers, as well as incorporating the outcomes of 15 workshops with different legal and justice actors around the world. The main question that emerged from this comprehensive process was: what can one do with the different legal futures that might come to be, as captured in the collection Law Scenarios to 2030? This question could be rephrased: who stragises? This volume brings you the reflections on this question by a diverse group of thought and practice leaders from different fields and parts of the world. Strategy in the justice sector is not an easy thing. At the same time, the need for coherent strategies seems urgent. This book seeks to be a catalyst for broad discussion on this challenge. It includes chapters by Geert Corstens (President, Dutch Supreme Court), Mark Ellis (Executive Director, International Bar Association), Adama Dieng (Special Adviser to the UN Secretary-General on Genocide), Kimberly Prost (Ombudsperson, Security Council's 1267 Committee), and Adel Maged (Vice President, Egyptian Court of Cassation).

Book excerpt: Legislative drafting is an extremely onerous, exacting and highly-skilled task. What is clearly conceived in the mind may not be easily expressed with clarity and precision in words. It is a highly technical discipline, and one of the most vigorous forms of writing. Few lawyers have the special combination of skills, aptitudes and temperament necessary for a competent draftsperson. This book provides, for the first time, detailed commentary on legislative drafting with a specific focus on the Commonwealth, covering: the ethics of legislative drafting, teaching, training and retention of drafters, the role of legislative drafting in good governance, keeping the statute book up-to-date, drafting by more than words: the use of graphics, labels and formulae in legislation; and the particular challenges of drafting for small states. It constitutes a key reference for legislative drafters, parliamentary counsel and professionals involved in this field in the Commonwealth and beyond. This book was based on a special issue of Commonwealth Law Bulletin.
