Book excerpt: This edited volume brings together contributions from experienced academics and practitioners in shipping law to consider the crucial subject of remedies in shipping litigation. The collection takes a close look at the established principles and recent legal, commercial and technical developments in the area of remedies in shipping law. It is divided into three parts. The first part focuses on fundamental common law principles concerning damages, including approaches to topics such as damages for delay and what happens when a charter is thrown over early; the reflective loss rule; mitigation; and the problem of cryptocurrency. The second part considers technology and how it affects contracts and remedies, including the use of new technologies and the development of new liability regimes. The third part explores contractual remedies other than simple compensatory damages, considering issues such as limitation of liability, punitive damages, specific remedies, third party claims and liabilities, and anti-suit injunctions. Written for lawyers and administrators not only in England and Wales but worldwide (especially Germany, Switzerland, Greece, Canada, Australia, New Zealand, China, Hong Kong, Singapore and India), the book will also be of interest to specialist maritime law firms in the USA. It will be a valuable addition to specialist law libraries within Europe and the USA, and to university libraries where maritime and shipping law are taught as specialist subjects.

This book was released on 2024-01-02 with total page 211 pages. Available in PDF, EPUB and Kindle. Book excerpt: Data sharing – broadly defined as the exchange of health-related data among multiple controllers and processors – has gained increased relevance in the health sciences over recent years as the need and demand for collaboration has increased. This includes data obtained through healthcare provisions, clinical trials, observational studies, public health surveillance programs, and other data collection methods. The practice of data sharing presents several notable challenges, however. Compliance with a complex and dynamic regulatory framework is essential, with the General Data Protection Regulation being a prominent example in a European context. Recent regulatory developments related to clinical trial transparency, trade secrecy, data access, AI training data, and health data spaces further contribute to the difficulties. Simultaneously, government initiatives often encourage scientists to embrace principles of “open data” and “open innovation.” The variety of regulations in this domain has the potential to impede widespread data sharing and hinder innovation. This edited volume, therefore, compiles comparative case studies authored by leading scholars from diverse disciplines and jurisdictions. The book aims to outline the legal complexities of data sharing. By examining real-world scenarios from diverse disciplines and a global perspective, it explores the normative, policy, and ethical dilemmas that surround data sharing in the health sciences today. Chapter Patient Perspectives on Data Sharing, Chapter Supplementary Measures and Appropriate Safeguards for International Transfers of Health Data after Schrems II are available open access under a Creative Commons Attribution 4.0 International License via link.springer.com.

Available in PDF, EPUB and Kindle. Book excerpt: This open access handbook describes foundational issues, methodological approaches and examples on how to analyse and model data using Computational Social Science (CSS) for policy support. Up to now, CSS studies have mostly developed on a small, proof-of concept, scale that prevented from unleashing its potential to provide systematic impact to the policy cycle, as well as from improving the understanding of societal problems to the definition, assessment, evaluation, and monitoring of policies. The aim of this handbook is to fill this gap by exploring ways to analyse and model data for policy support, and to advocate the adoption of CSS solutions for policy by raising awareness of existing implementations of CSS in policy-relevant fields. To this end, the book explores applications of computational methods and approaches like big data, machine learning, statistical learning, sentiment analysis, text mining, systems modelling, and network analysis to different problems in the social sciences. The book is structured into three Parts: the first chapters on foundational issues open with an exposition and description of key policymaking areas where CSS can provide insights and information. In detail, the chapters cover public policy, governance, data justice and other ethical issues. Part two consists of chapters on methodological aspects dealing with issues such as the modelling of complexity, natural language processing, validity and lack of data, and innovation in official statistics. Finally, Part three describes the application of computational methods, challenges and opportunities in various social science areas, including economics, sociology, demography, migration, climate change, epidemiology, geography, and disaster management. The target audience of the book spans from the scientific community engaged in CSS research to policymakers interested in evidence-informed policy interventions, but also includes private companies holding data that can be used to study social sciences and are interested in achieving a policy impact.
