The main issue is that international law traditionally recognizes the right of states to safeguard their own rights by resorting to countermeasures as well as the obligation to settle their disputes by accepted and recognized diplomatic and judicial procedures. Both concepts are based on their own merits, which are assumed to be valid in contemporary international law. Book excerpt: Proactive policing, as a strategic approach used by police agencies to prevent crime, is a relatively new phenomenon in the United States. It developed from a crisis in confidence in policing that began to emerge in the 1960s because of social unrest, rising crime rates, and growing skepticism regarding the effectiveness of standard approaches to policing. In response, beginning in the 1980s and 1990s, innovative police practices and policies that took a more proactive approach began to develop. This report uses the term "proactive policing" to refer to all policing strategies that have as one of their goals the prevention or reduction of crime and disorder and that are not reactive in terms of focusing primarily on uncovering ongoing crime or on investigating or responding to crimes once they have occurred. Proactive policing is distinguished from the everyday decisions of police officers to be proactive in specific situations and instead refers to a strategic decision by police agencies to use proactive police responses in a programmatic way to reduce crime. Today, proactive policing strategies are used widely in the United States. They are not isolated programs used by a select group of agencies but rather a set of ideas that have spread across the landscape of policing. Proactive Policing reviews the evidence and discusses the data and methodological gaps on: (1) the effects of different forms of proactive policing on crime; (2) whether they are applied in a discriminatory manner; (3) whether they are being used in a legal fashion; and (4) community reaction. This report offers a comprehensive evaluation of proactive policing that includes not only its crime prevention impacts but also its broader implications for justice and U.S. communities.

Urban society, beset by increases in crime and violence and the growing irrelevancy of primary socializing agents, must look to the police, the institutionalized control agency, for the preservation of peace, order, and tranquility in the community. The dilemma of a democratic society is how to give the police sufficient power to perform their role effectively, while at the same time maintaining restraints on the police in order to prevent abuses to democratic principles. This book looks at the discretionary conduct of policemen and whether adequate accountability measures exist -- and, if not, whether they can be realized, while allowing for the necessary development of police capabilities in the performance of requisite functions. In its focus on the behavior of police officials and the relationship of the police bureaucracy to the urban political system, the work strives to be both descriptive and prescriptive. The author uses examples from a cross-section of American cities and focuses on Memphis, Tennessee to illustrate the political events and social factors which effect policing. Collective police power is measured by the extent of their discretionary authority and freedom from external controls, individual power is perceived by the rational strategies on the part of police officials striving to attain or consolidate their personal power positions in the organization. Implicit in the police's struggle for power -- both personal and collective -- is the existence of conflict with challenging institutional and environmental forces and actors.

In Sex Offenders, Stigma, and Social Control, Diana Rickard provides the reader with an in-depth view of six such men, exploring how they manage to cope with their highly stigmatized role as social outcasts. The six men discussed in the book are typical convicted sex offenders—neither serial pedophiles nor individuals convicted of the type of brutal act that looms large in public perceptions about sex crimes. Sex Offenders, Stigma, and Social Control explores how these individuals, who have been cast as social pariahs, construct their sense of self. How does being labeled in this way and controlled by measures such as Megan’s Law affect one’s identity and sense of social being? Book excerpt: An empirical study of police shows how value conflicts of democratic society create conditions that undermine the capacity of police to respond to the rule of law. Data for the study were drawn from an examination of criminal law officials in a city of approximately 400,000 with a nonwhite population of about 30 percent. The gathering of data began in the summer of 1962 and extended into the summer of 1963. The city involved is reputed to have an exemplary criminal justice structure. Through a questionnaire and direct observation, patterns of police behavior were examined in a variety of areas of law enforcement, including traffic violations, prostitution, and narcotics. A sketch of the policeman's "working personality" is presented, along with a description of his operational environment and use of discretion. His use of informers is also treated. Police attitudes toward criminal law and views of the exclusionary rule are examined. Facts presented in the study were deemed accurate by all individuals questioned and observed, although there was not always agreement on interpretations given to the data. It is concluded that the tension between the operational goals of order, efficiency, and initiative on the one hand and the protection of the legal rights of individual citizens on the other constitutes the principle problem of police as a democratic legal organization. The appendix includes a brief survey of the character of the city studied, comparative data on the police, a history and organization of the offices of public defender and district attorney in La Loma County, California, and the questionnaire given to the police.
