On pense immédiatement aux violences physiques ou sexuelles, infligées dans la famille, mais aussi hors la famille, dans la rue ou dans des institutions, parfois même dans des structures relevant du dispositif de protection de l'enfance. Face à cette réalité, a émergé un droit pénal spécifique qui contribue à dessiner un statut de l'enfant. Ce dernier peut être victime d'infractions de droit commun ou d'infractions spécifiques. Et le fait que la victime soit mineure peut être une circonstance aggravante. Une procédure pénale particulière s'efforce en outre de compenser la faiblesse de l'enfant à se faire rendre justice. L'enfant victime a ainsi acquis le droit d'être acteur de la procédure contre son agresseur, notamment par l'introduction de dispositions lui facilitant la parole. Indéniablement, on va dans le bon sens avec une meilleure prise en compte des enfants victimes d'infractions pénales. Reste que composé de nombreuses règles ou dispositions entassées les unes sur les autres, accumulées au fil du temps et des réactions du moment, ce droit peut apparaître disparate, confus, complexe, difficilement intelligible.
