Depending on the dynamics of the market and the level of the standard, the effect on the market for a given product may be small, moderate, or large. Energy efficiency standards address a number of market failures that exist in the buildings sector. Decisions about efficiency levels often are made by people who will not be responsible for the energy bill, such as landlords or developers of commercial buildings. Many buildings are occupied for their entire lives by very temporary owners or renters, each unwilling to make long-term investments that would mostly reward subsequent users. And sometimes what looks like apathy about efficiency merely reflects inadequate information or time invested to evaluate it. In addition to these sector-specific market failures, energy efficiency standards address the endemic failure of energy prices to incorporate externalities. In the U.S., energy efficiency standards for consumer products were first implemented in California in 1977. National standards became effective starting in 1988. By the end of 2001, national standards were in effect for over a dozen residential appliances, as well as for a number of commercial sector products. Updated standards will take effect in the next few years for several products. Outside the U.S., over 30 countries have adopted minimum energy performance standards. Technologies and markets are dynamic, and additional opportunities to improve energy efficiency exist. There are two main avenues for extending energy efficiency standards. One is upgrading standards that already exist for specific products. The other is adopting standards for products that are not covered by existing standards. In the absence of new and upgraded energy efficiency standards, it is likely that many new products will enter the stock with lower levels of energy efficiency than would otherwise be the case. Once in the stock, it is either impossible or more costly to improve the energy efficiency. Therefore, by not expanding or upgrading energy efficiency standards, opportunities for saving energy would be lost. In the past two decades, standards have significantly raised the level of energy efficiency for new products. How much more might be gained by making standards more stringent on products already subject to them, or by extending standards to products not yet covered? The main goal of this study is to estimate key national impacts of new and upgraded energy efficiency standards for residential and commercial equipment. These impacts approximate the opportunity for national benefits that may be lost if standards are not upgraded and expanded from current levels. This study also identifies the end uses where the largest opportunities exist. This analysis was prepared for the National Commission on Energy Policy (NCEP). It uses an analytical approach that is similar in concept to that used by the U.S. Department of Energy (DOE) to set standard levels. It relies on much less data and uses more simplified assumptions than the detailed and complex formulations used in DOE's standard-setting process. The results of this analysis should thus be viewed as a first approximation of the impacts that would actually be achieved by new standards. All monetary values in this report are in 2002 dollars.

EPCA further provides with respect to certain equipment covered by this rule, that if the American Society of Heating, Refrigerating and Air-Conditioning Engineers (ASHRAE) and the Illuminating Engineering Society of North America (IESNA) amend ASHRAE/IESNA Standard 90.1 as in effect on October 24, 1992, then the Department of Energy (DOE) must establish amended national standards at the ASHRAE/IESNA Standard 90-1 minimum energy efficiency levels unless DOE determines that evidence supports adoption of higher standard levels or certain other circumstances exist. ASHRAE/IESNA amended ASHRAE/IESNA Standard 90.1 on October 29, 1999 (ASHRAE/IESNA Standard 90.1-1999), and DOE initiated this rulemaking to consider amendments to the national standards. DOE has concluded that it lacks authority to pursue higher standards for gas-fired instantaneous water heaters and large commercial packaged boilers. For small commercial packaged boilers with capacities greater than 300,000 Btu/h and less than or equal to 2.5 million British thermal units per hour, DOE is declining to adopt revised efficiency standards contained in the ASHRAE/IESNA Standard 90.1-1999 because the revised levels are less stringent than the current national standard. In addition, DOE has decided to conduct a separate rulemaking to consider whether standards at higher levels than those in the ASHRAE/IESNA Standard 90.1-1999 are warranted for packaged terminal air conditioners and packaged terminal heat pumps. Finally, DOE has concluded it does not have the authority to adopt, as uniform national standards, efficiency standards contained in Addenda f and b, respectively, to ASHRAE/IESNA Standard 90.1-2004 for three-phase air conditioners and heat pumps with cooling capacities less than 65,000 British thermal units per hour, and single-package vertical air conditioners and single-package vertical heat pumps with cooling capacities less than 65,000 Btu/h. Updated as of May 29, 2018 The Energy Policy and Conservation Act of 1975 (EPCA), as amended, prescribes energy conservation standards for various consumer products and certain commercial and industrial equipment, including residential central air conditioners and heat pumps. EPCA also requires the U.S. Department of Energy (DOE) to periodically determine whether more-stringent, amended standards would be technologically feasible and economically justified, and would save a significant amount of energy. Book excerpt: Urbanization and growing wealth in developing countries portend a large increase of demand for modern energy services in residential, commercial and public-service buildings in the coming decades. Pursuing energy efficiency in buildings is vital to energy security in developing countries and is identified by the Intergovernment Panel on Climate Change as having the greatest potential for cost-effective reduction of CO2 emissions by 2030 among all energy-consuming sectors. Building energy efficiency codes (BEECs), along with energy efficiency standards for major appliances and equipment, are broadly recognized as a necessary government intervention to overcome persistent market barriers to capturing the economic potential of energy efficiency gains in the residential, commercial and public-service sectors. Implementation of BEECs help prevent costly energy wastes over the lifecycles of buildings in space heating, air conditioning, lighting, and other energy service requirements. Nonetheless, achieving the full potential of energy savings afforded by more energy-efficient buildings requires holding people who live or work in buildings accountable for the cost of energy services. Compliance enforcement has been the biggest challenge to implementing BEECs. This report summarizes the findings of an extensive literature survey of the experiences of implementing BEECs in developed countries, as well as those from case studies of China, Egypt, India, and Mexico. It also serves as a primer on the basic features and contents of BEECs and the commonly adopted compliance and enforcement approaches. This report highlights the key challenges to improving compliance enforcement in developing countries, including government commitment to energy efficiency, the effectiveness of government oversight of the construction sector, the compliance capacity of building supply chain, and financing constraints. The report notes that the process of transforming a country s building supply chain toward delivering increasingly more energy-efficient buildings takes time and requires persistent government intervention through uniformly enforced and regularly updated BEECs. The report recommends increased international support in strengthening the enforcement infrastructure for BEECs in middle-income developing countries. For low- and lower-middle-income countries, there is an urgent need to assist in improving the effectiveness of government oversight system for building construction, laying the foundation for the system to also cover BEECs.
