Will this "uncapping" of the retirement age adversely affect the vitality of academic departments or the prospects of advancement for younger scholars? In a definitive study of faculty retirement in the arts and sciences, Albert Rees and Sharon Smith seek to answer this question. Basing their conclusions on original data collected from thirty-three colleges and universities, they do much to resolve an issue that is a frequent subject of discussion in the academic world and in the press. Rees and Smith reveal that the ending of mandatory retirement will have much smaller effects than those generally anticipated--so small that there is no justification for efforts to have Congress continue exempting faculty members from the ADEA past 1994, the date that the exemption is now due to expire. Among the topics discussed are: the effects of uncapping on faculty retirement; faculty performance and institutional quality; pensions, retirement programs and costs; and retirement incentive programs. Two key conclusions are presented: (1) at most colleges and universities, few tenured faculty would continue working past age 70 if mandatory retirement is eliminated; and (2) at some research universities, a high proportion of faculty would choose to work past age 70 if mandatory retirement is eliminated. Committee recommendations include suggestions for continuing retirement income; the adoption of policies by Congress, the Internal Revenue Service, and the Equal Opportunity Commission concerning employer contributions based on estimated level of pension income; and minimum and maximum goals for inflation-protected pension income for better resource allocation and the limiting of inadvertent incentives to postpone retirement. Appendices include a description of study methods, discussion of national faculty databases, and a summary of the characteristics of institutions and faculty, and biographical sketches of committee members and staff. In this paper, examination of retirements in 1993 (just before the end of this practice) and again 10 years later shows that by 2003, the age distribution of doctoral scientists and engineers working in postsecondary institutions had shifted, with a larger proportion being older than 56 years of age, compared with 1993. However, this is not solely due to changes in the propensity of the older age groups to retire. Tracking retirement is a challenge because many individuals continue to work in another capacity after officially retiring from one job, and others move in and out of retirement in the same type of job. In this report, "retired individuals" are those whose most recent employment was in a postsecondary institution and are not working because they have retired, and those who have retired but are working part time in any sector. It does not include individuals who retired from a postsecondary institution and later returned to full-time employment in any sector. (Contains 1 figure, 4 tables and 6 notes.).

This book traces the history of these endeavors through extensive use of unpublished archival materials, including letters, diaries, and records of institutional decisions. Developments at Yale are set against the wider background of changing American attitudes toward the Near East, as well as evolving ideas about the role of the academy and its curriculum in educating undergraduate and graduate students. In the case of the Near East, this also involves considering how several of its disciplines made the transition from biblically motivated enterprises to secular fields of study. Yale has notable firsts to her credit: the first American professional program in Arabic and Sanskrit; the first American learned society and periodical devoted to Oriental subjects; the first American research institutes in Jerusalem and Baghdad; the first American university to have endowed funds to establish and curate one of the world's largest collections of cuneiform tablets and cylinder seals. Yet at the same time, especially over the past half-century, Yale has found it challenging to deal administratively with a small humanities department whose standards and philosophy of teaching and learning seemed increasingly at odds with trends in the university as a whole. Richard Epstein demonstrates that these laws set one group against another, impose limits on freedom of choice, undermine standards of merit and achievement, unleash bureaucratic excesses, mandate inefficient employment practices, and cause far more invidious discrimination than they prevent.
