With chapters written by some of the foremost practitioners in the field, the new edition of Endangered Species Act: Law, Policy, and Perspectives is an essential reference for conservationists and the regulated community and the attorneys who represent them."---Bruce Babbbitt, former Secretary of the Interior --

Available in PDF, EPUB and Kindle. Book excerpt: The Endangered Species Act of 1973 (ESA) is one of the most cherished and reviled laws ever passed. It mandates protection and preservation of all the nation’s species and biodiversity, whatever the cost. It has been a lightning rod for controversy and conflicts between industry/business and environmentalists. The year 2023 marks the 50th anniversary of this law, and provides an opportunity for a measured and thorough evaluation thereof. We cannot know today’s challenges and opportunities without understanding their histories. This book is the most comprehensive history of the ESA ever published, and the first to consider the entire history of the law from all angles in a single volume. The history of the ESA has been one of increasing impact, complexity, and controversy. In 1978, the Supreme Court declared that Congress intended for the U.S. government to save all species at any cost, and thereafter application of the ESA became steadily more controversial, as seen in the example of the northern spotted owl and the timber wars in the Pacific Northwest in the late 1980s and early 90s, and then everywhere as the ESA became a political football in the highly partisan environment of the late 1990s and amendments to the law ceased. This book is not only a history, but a call to action. It will take more conservation, more funding, and more innovative solutions if we are to save our wildlife and biodiversity. It will take the engagement to every American to muster the collective will to meet this challenge. The hope of this book is that we will be able to look back and say that we accomplished more in the second 50 years of the ESA than we did in the first.

Book excerpt: The new model of policy design theory frames the discussion regarding the frequently analyzed Endangered Species Act (ESA) in this historical perspective. Since the 1970s, the Endangered Species Act (ESA), by virtue of its regulatory impact, has been a frequent subject of policy analysis. In this comprehensive history and critique of the ESA, Brian Czech and Paul R. Krausman incorporate the new model of policy design theory to frame a larger discussion about conservation biology and American democracy. Czech and Krausman provide a historical background of endangered species policy that integrates natural history, socioeconomic trends, political movements, and professional developments. Outlining the controversies surrounding the ESA, they find a connection between challenges to species conservation and challenges to democracy. After an assessment of ESA analyses that have been performed from traditional perspectives, they engage policy design theory to review the structural logic of the ESA, analyzing each clause of the legislation for its application of the fundamental elements of democracy. To address the technical legitimacy of ESA, they propose two new genetic considerations—functional genome size and molecular clock speed—to supplement phylogenetic distinctiveness as criteria with which to prioritize species for conservation. Next, they systematically describe the socioeconomic context of ESA by assessing and classifying the causes of species endangerment. A hybrid of policy analysis and ecological assessment, The Endangered Species Act: History, Conservation Biology, and Public Policy will appeal to scholars and students in the fields of natural resource policy and law, conservation biology, political science, wildlife ecology, and environmental history, and to professionals at agencies involved in wildlife conservation.

Book excerpt: Leading philosophers Alice Crary and Lori Gruen offer a searing and desperately needed response to systems of thought and action that are failing animals and, ultimately, humans too. In the wake of global pandemics, mass extinctions, habitat destruction, and catastrophic climate change, they issue a clarion call to address the intertwined problems we face, arguing that we must radically reimagine our relationships with other animals. In stark contrast to traditional theories in animal ethics, which abstract from social mechanisms harmful to human beings, Animal Crisis makes the case that there can be no animal liberation without human emancipation. Borrowing from critical theories such as ecofeminism, Crary and Gruen present a critical animal theory for understanding and combating the structural forces that enable the diminishment of so many to the advantage of a few. With seven case studies of complex human-animal relations, they make an urgent plea to dismantle the “human supremacism” that is devastating animal lives and hurtling us toward ecocide.
