Successful reintroduction of a population within the species' historic range would contribute to its viability and further its conservation. The issuance of limited protective regulations will provide for the conservation of the species while providing assurances to people in the Okanogan River subbasin. The geographic boundary for the NEP is the main stem and all tributaries of the Okanogan River between the Canada-United States border and to the confluence of the Okanogan River with the Columbia River, Washington (hereafter "Okanogan River NEP Area"). We have prepared a Final Environmental Assessment (EA) and Finding of No Significant Impact (FONSI) on the proposed action under the National Environmental Policy Act (NEPA) (see ADDRESSES: section below). Updated as of May 29, 2018 We, the National Marine Fisheries Service (NMFS), are issuing a final rule to authorize the continued release of Middle Columbia River (MCR) steelhead (Oncorhynchus mykiss) that are currently being reintroduced as part of an ongoing reintroduction effort into the upper Deschutes River basin in portions of Jefferson, Crook, and Deschutes Counties, Oregon, and designate them as a nonessential experimental population (NEP) under the Endangered Species Act (ESA) of 1973. The geographic boundaries of the NEP extend upstream from Round Butte Dam on the Deschutes River (about river mile (RM) 110, river kilometer (rkm) 177) and all accessible reaches of the Deschutes River and its tributary Whychus Creek; on the Crooked River from its confluence with the Deschutes River upstream to Bowman Dam (RM 70, rkm 113) and all accessible tributaries between these points; and on the Metolius River from its confluence with the Deschutes River upstream to all accessible tributaries between these points. This NEP designation will have an expiration date 12 years from the effective date of this final rule. We anticipate providing a notice in the Federal Register about 1 year before the NEP designation is set to expire to provide adequate notice to the public. Over the last 10 years of available data (2003 - 2013), the abundance of spawning winter-run Chinook adults ranged from a low of 738 in 2011 to a high of 17,197 in 2007, with an average of 6,298. The population subsists in large part due to agency-managed cold water releases from Shasta Reservoir during the summer and artificial propagation from Livingston Stone National Fish Hatchery's winter-run Chinook salmon conservation program. Winter-run Chinook salmon are dependent on sufficient cold water storage in Shasta Reservoir, and it has long been recognized that a prolonged drought could have devastating impacts, possibly leading to the species' extinction"--page 2, paragraph 1.

This included information provided by the Petitioners in their petition, information deemed pertinent by the BRT, and information provided to the NMFS Southwest Regional Office by other parties interested in this issue. The purpose of this Technical Memorandum is to document the BRT's review and analysis of this information and to report their findings. Mo st importantly, the BRT concluded that the new information supported the existing UKT R Chinook ESU configuration with spring- run and fall-run populations included in a single ESU, and that the ESU is currently at a low risk of extinction within the next 100 years"--Executive summary.
