It is only recently that the U.S. has begun to extend full protection at the national level against employment discrimination based on gender identity. While this issue has been debated in the U.S., as in other developed countries, since the rise of second wave feminism and the gay liberation movement, the policy debate at the national level has taken off since 2007 as the U.S. has repeatedly failed to pass the federal Employment Non Discrimination Act (ENDA). Recent U.S. policy discourse on employment discrimination for the lesbian, gay, bisexual, transgender and queer (LGTBQ) communities has focussed specifically on the relationship between sexual orientation and gender identity. Gender identity itself and the protection of trans people from employment discrimination has been highly politicized in the U.S. debate around employment protection for lesbians, bisexuals and gay men. This paper explores the legal and policy debates over discrimination protection. Drawing on historical institutionalist theory, I argue that strong courts, federalism, and the separation of powers have not only influenced policy outcomes in this area but, more importantly, the ways in which the issues have been discussed and debated. Court rulings have played an important role in influencing legal and political understandings and definitions of key concepts such as gender, gender identity and sexual orientation. These concepts are reinforced in LGBT communities as well as by LGBT legal elites and NGOS; however, their particular evolution cannot be understood without reference to the institutional and legal structure of American institutions. Federalism has divided authority over the issue of employment discrimination, producing policy change in some states and localities and not others.
