Book excerpt: "Islamic Law and International Law is a comprehensive examination of differences and similarities between the Islamic legal tradition and international law, especially in the context of dispute settlement. Sharia embraces a unique logic and culture of justice--based on nonconfrontational dispute resolution--as taught by the Quran and the Prophet Muhammad. This book explains how the creeds of Islamic dispute resolution shape the Islamic milieu's views of international law. Is the Islamic legal tradition ab initio incompatible with international law, and how do states of the Islamic milieu view international courts, mediation, and arbitration? Islamic law constitutes an important part of the domestic legal system in many states of the Islamic milieu--Islamic law states--displacing secular law in state governance and affecting these states' contemporary international dealings. The book analyzes constitutional and subconstitutional laws in Islamic law states. The answer to the "Islamic law-international law nexus puzzle" lies in the diversity of how secular laws and religious laws fuse in domestic legal systems across the Islamic milieu. These states are not Islamic to the same degree or in the same way. Thus, different international conflict management methods appeal to different states, depending on each one's domestic legal system. The main claim of the book is that in many instances the Islamic legal tradition points in one direction while Western-based, secularized international law points in another direction. This conflict is partially softened by the reality that the Islamic legal tradition itself has elements fundamentally compatible with modern international law. Islamic legal tradition, international law, sharia settlement, peaceful dispute resolution"--

Available in PDF, EPUB and Kindle. Book excerpt: International courts have proliferated in the international system, with over one hundred judicial or quasi-judicial bodies in existence today. This book develops a rational legal design theory of international adjudication in order to explain the variation in state support for international courts. Initial negotiators of new courts, 'originators', design international courts in ways that are politically and legally optimal. States joining existing international courts, 'joiners', look to the legal rules and procedures to assess the courts' ability to be capable, fair and unbiased. The authors demonstrate that the characteristics of civil law, common law and Islamic law influence states' acceptance of the jurisdiction of international courts, the durability of states' commitments to international courts, and the design of states' commitments to the courts. Furthermore, states strike cooperative agreements most effectively in the shadow of an international court that operates according to familiar legal principles and rules.

Teo's mother died immediately, but Em's survived, determined to raise Teo according to his late mother's wishes-in a place where he won't be discriminated against because of the color of his skin. But in 1930s America, a white woman raising a black adoptive son alongside a white daughter is too often seen as a threat. Seeking a home where her children won't be held back by ethnicity or gender, Rhoda brings Em and Teo to Ethiopia, and all three fall in love with the beautiful, peaceful country. But that peace is shattered by the threat of war with Italy, and teenage Em and Teo are drawn into the conflict. Will their devotion to their country, its culture and people, and each other be their downfall or their salvation? In the tradition of her award-winning and bestselling Code Name Verity, Elizabeth Wein brings us another thrilling and deeply affecting novel that explores the bonds of friendship, the resilience of young pilots, and the strength of the human spirit.

Available in PDF, EPUB and Kindle. Book excerpt: How can we be just and merciful? Are justice and mercy in conflict? Or are they aspects of the same truth? Christians in America are presented with two conflicting versions of justice and mercy. One version comes from the dominant secular narrative of America. Justice and mercy are contradictions. Mercy is devalued and discouraged. But within the counter narrative of God revealed through Torah, the prophets, and particularly through the life and parables of Jesus, justice and mercy are aspects of the same truth and way of God. There is no justice without mercy. There is no mercy without justice. In this book, Rev. Brooks Harrington draws on more than 40 years' experience as a criminal prosecutor, a pastor of an inner-city church in an impoverished neighborhood, and the founder of a legal ministry protecting indigent victims of family violence and child neglect and abuse. Through moving stories of women and children he has encountered, he shows the terrible toll of the dominant narrative's version of justice and mercy. And he offers Christians hope with new and startling insights into God's justice and mercy revealed in the parables of Jesus.

Available in PDF, EPUB and Kindle. Book excerpt: Loris Malaguzzi was one of the most important figures in 20th century early childhood education, achieving world-wide recognition for his educational ideas and his role in the creation of municipal schools for young children in the Italian city of Reggio Emilia, the most successful example ever of progressive, democratic and public education. Despite Malaguzzi’s reputation, very little of what he wrote or said about early childhood education has been available in English. This book helps fill the gap, presenting for the first time in English, writings and speeches spanning 1945 to 1993, selected by a group of his colleagues from an archive established in Reggio Emilia. They range from short poems, letters and newspaper articles to extended pieces about Malaguzzi’s early life, the origins of the municipal schools and his ideas about children, pedagogy and schools. This material is organised into five chronological chapters, starting at the end of World War Two and ending just before his death, with introductions to each chapter providing background, including the historical context, the main events in Malaguzzi’s life and the rationale for the selection of documents. The book provides a unique insight into the background, thinking and work of Malaguzzi, revealing, in his own words, how his thinking developed, how he moved between theory and practice, how he border-crossed many disciplines and subjects, and how he combined many roles ranging from administrator and campaigner to researcher and pedagogue. Academics, students and practitioners alike will find this landmark publication provides rich insights into his life and work.

Book excerpt: In Public Justice and the Criminal Trial in Late Medieval Italy: Reggio Emilia in the Visconti Age, Joanna Carraway Vitiello examines the criminal trial at the end of the fourteenth century. Inquisition procedure, in which a powerful judge largely controlled the trial process, was in regular use in the criminal court at Reggio. Yet during the period considered in this study, technical procedural developments combined with the political realities of the town to create a system of justice that prosecuted crime but also encouraged dispute resolution. Following the stages of the process, including investigation, denunciation, the weighing of evidence, and the verdict, this study investigates the court’s complex role as a vehicle for both personal justice and prosecution in the public interest.
