Book excerpt: Excerpt from Elements of Equity for the Use of Students The present work has been prepared in a similar style to that of the authors Elements of Torts. An attempt has been made to present the subject of equity jurisprudence in the concrete, to show to the student the actual working of the system of equity in the administration of justice. Equity, however, is a more difficult subject than torts in which to carry out such an attempt. The facts litigated in equity causes are generally complicated; and short, forcible examples are difficult to find in the Reports. For this reason, fewer examples taken directly from the facts of particular causes will be found in this work than in its predecessor; but this necessary defect has been supplied, as far as possible, by connecting the principles stated with appropriate and usual classes of facts. Book excerpt: Excerpt from The Principles of Equity: Intended for the Use of Students and the Profession IN this twelfth edition of the Principles of Equity (being the ninth which I have done), I have endeavoured to maintain the qualities of accuracy and of simplicity, the combination of which in the previous editions has so largely secured the acceptability of Snell with students. Since the date of the last edition, there have been only two statutes, - the Judi cial Trustees Act, 1896, and the Land Transfer Act, 1897, - of any material importance in equity; but the growth of the new decisions, being new developments of the principles of equity, has been very great; and the size of the book has (i regret to say) been thereby necessarily increased, there being no fewer than seventy-two pages of new text alone, besides the other incidental additions. I have, however, studied the greatest brevity and I have adopted in this edition, and have consistently maintained throughout it, a somewhat novel and laborious mode of punctuation, by means of which I have relieved considerably the labours of the student. Book excerpt: Excerpt from The Principles of Equity: Intended for the Use of Students and Profession Since the appearance of the First Edition of this book, the Author has died, and left to his friends the regret that a life so assiduous and full of future promise has been prematurely cut short. In preparing a Second Edition of the work, the Editor has attempted, While following as far as possible the Author's division of the subject, to bring it down to the present date, by reference to the more important changes effected by subsequent statute or case law, Without, at the same time, unduly expanding its size, or overloading its pages With cases. The Whole book has been carefully revised, and reference has been made to the latest authorities. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from A Manual of the Principles of Equity: A Concise and Explanatory Treatise Intended, for the Use of Students the Profession The confidence I expressed in my preface to the last edition of this work, as to its success, has proved well founded, and I am very pleased to be able to now present a new, and, I trust, still further improved edition. I have spared no pains in my effort to make the book specially suitable fur students, but, at the same time, I have not lost sight of the fact that it is intended to be useful in a limited way to practitioners. Above all, I have striven to give plain and definite statements, and, appreciating the value of illustrations, I have given them as far as space permitted. As it is, I have been obliged to make this edition a little larger than the previous one, but even now I think it will be admitted that the book is of very moderate dimensions for a work on such a wide and important subject. Over four years have elapsed since the Fourth Edition was published, and thorn have been a number of important cases decided during that period. I have endeavoured to select the best of these, and think that I have omitted nothing of material importance. The Chapter on Administration has been to a great extent re-written, and though it is too much to hope that it is in ail its details entirely correct, I think that it is mainly so, and I trust that the subject will be found dealt with in a manner capable of being understood. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Equity and Its Remedies This book is the outcome of lectures delivered by the author at the Evening Law School of the Boston Y. M. C. A. And at the Law School of Boston Univer sity, on the equitable remedies. The justification for putting the material in this form is found in the expressions of gratitude from former students who have been good enough to say that they have found in these lectures citations and statements of principles inaccessible in any text-book. The frequency with which the author has turned to these notes for cita tions in his own practise has convinced him that others of the profession may be able to find assistance from the same source. The book is an attempt to give a rational outline of equity (exclusive of trusts and kindred subjects) and to show the scope of the equitable remedies. It does not attempt to deal with strictly statutory subjects or with equity pleading or practice. While the citations are largely drawn from Massa chusetts cases (and Ames's Cases on Equity), it is believed the subject is treated in such a way as to make the book of general application, useful to the student or practitioner in any part of the United States. No attempt has been made to cite all the equity cases decided in Massachusetts, although cer tain parts of the subject, not covered by existing text-books, have been treated with thoroughness. Special attention has been given to late cases. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from An Outline of the Equity Pleading and Practice: With Forms and the Federal Equity Rules, Prepared for the Use of the Students of the School, of the University of Virginia This small volume is largely the result of many years of effort to collect the fundamental principles of the Equity Pleading and Practice for the use of the author's students in class-room instruction. The topic is one that can successfully be taught to students only by confining the instruction largely to the procedure of some particular jurisdiction. Numerous attempts to use the larger well-known texts in the class-room have proved hopeless failures. The author has therefore drawn very largely upon the system of procedure as it exists in Virginia, where the procedure at law and in equity is stillas distinct as when Lord Bacon occupied the woolsack - and where the equity procedure probably conforms more nearly to that of Bacon's day than that of any American state. In the treatment of the subject of Receivers, free use has been made of Mr. High's scholarly treatise, for which due acknowledgment is made. If, in so elementary a work, the subject of Receiver ships seems overstressed in comparison with the briefer treatment of other topics of equal or greater importance, the explanation is that it was found impracticable to handle thesubject in less compass, even in most elementary fashion. Detailed reference is made throughout to the new Federal Equity Rules - and these rules have been reproduced in full in the Appendix. It is hoped that the complete record of a chancery suit, as exhibited in the Appendix, may assist the student in visualizing the actual procedure in court, and in cultivating a closer acquaintance with those forms which he is expected as a practitioner to have at his fingers' ends. In order to fulfill its primary end as a guide to the student through what seems to the average undergraduate a dull and uninviting territory, the value of the work to the experienced practitioner has been sacrificed, by the omission of many minute points of practice. Book excerpt: Excerpt from A Manual of the Principles of Equity: A Concise and Explanatory Treatise Intended for the Special Use of Students Though some may be much gratified to see the comparative smallness of this work, others may be somewhat alarmed by that very feature, at which I have designedly aimed. I wish to say something to each of these two classes. I recommend to all some reference to the established Leading Cases during the perusal of this work. Those who are unable to refer to White and Tudor, should at least fully refer to my Epitome of Leading Conveyancing and Equity Cases and, to those who are able to, I heartily recommend a thorough reference from time to time to, and study of, White and Tudor Those who will thus 3t will, I am sure, attain a good and sound knowledge of the Principles of Equity. One word more, and that is with reference to my division of the subject. It is, at any rate, somewhat novel; I do not profess that it is scientific. I do, however, think that it is a clear and plain one, and. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Outlines of Equity: A Concise View of the Principles of Modern Equity Though this little book may not merit the description Parvus est libellas at medulla scatet, it contains a great deal of matter in a small compass, and is an attempt -to put the pith of the subject into a few pages. As a pocket compendium, it is hoped that it may prove of use to the Profession in furnishing aids to the Student and reminders to the busy Practitioner. A great amount of time and labour, out of all proportion to the size of the book, has been expended in reducing it to its present dimensions, With the object of placing before the reader an accurate and fairly com prehensive view of the subject according to the latest decisions. How far the Author has succeeded must be left for others to judge. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
