Su propia denominación no es demasiado afortunada, pues se está ante una vía procesal que extiende su ámbito objetivo a las pretensiones de reparación de lesiones de otros derechos fundamentales cuyo conocimiento figura también atribuido a la competencia de los órganos jurisdiccionales del orden social. Aunque muchas de las deficiencias de aquella regulación y de las dificultades de su interpretación se han ido superando a través de los criterios que aparecen incorporados a las decisiones judiciales que la aplican, las reformas experimentadas por el proceso laboral crean nuevos problemas de los que también da cuenta la presente monografía.
