Available in PDF, EPUB and Kindle. Book excerpt: The gig economy, precarious work, and nonstandard employment have forced labor law scholars to rethink their discipline. Classical remedies for unequal power, capabilities approaches, "third way" market regulation, and laissez-faire all now vie for attention - at least in English. Despite a deep history of labor activism, Latin American scholarship has had scant presence in these debates. This book introduces to an English-language audience another approach: principled labor law, based on Latin American perspectives, using a jurisprudential method focused on worker protection. The authors apply this methodology to the least likely case of labor-protective jurisprudence in the industrialized world: the United States. In doing so, Gamonal and Rosado focus on the Thirteenth Amendment as a labor-protective constitutional provision, the National Labor Relations Act, and the Fair Labor Standards Act. This book shows how principled labor law can provide a clear and simple method for consistent, labor-protective jurisprudence in the United States and beyond.

Book excerpt: The problem of legal normativity is one the most controversial issues in the philosophy of law. It was already a subject of heated debate in the 19th century and, over the last 100 years, the study of normativity has taken many shapes and forms, from Kelsen's dualism, through the reductionism proposed by legal realists, to some nihilistic stances. In recent years, there has been a renewed interest in the problems surrounding the concept of law's normativity, and this collection is seen as a contribution to that debate. The book will be of interest to lawyers and philosophers, both at the graduate and professional levels.

Available in PDF, EPUB and Kindle. Book excerpt: Since its inception, anthropology's authority has been based on the assumption that it is a unified discipline emanating from the West. In an age of heightened globalization, anthropologists have failed to discuss consistently the current status of their practice and its mutations across the globe. World Anthropologies is the first book to provoke this conversation from various regions of the world in order to assess the diversity of relations between regional or national anthropologies and a contested, power-laden Western discourse. Can a planetary anthropology cope with both the 'provincial cosmopolitanism' of alternative anthropologies and the 'metropolitan provincialism' of hegemonic schools? How might the resulting 'world anthropologies' challenge the current panorama in which certain allegedly national anthropological traditions have more paradigmatic weight - and hence more power - than others? Critically examining the international dissemination of anthropology within and across national power fields, contributors address these questions and provide the outline for a veritable world anthropologies project.

Available in PDF, EPUB and Kindle. Book excerpt: Jonathan Dancy presents a long-awaited exposition and defence of particularism in ethics, a view with which he has been associated for twenty years. He argues that the traditional link between morality and principles, or between being moral and having principles, is little more than a mistake. The possibility of moral thought and judgement does not in any way depend on an adequate supply of principles. Dancy grounds this claim on a form of reasons-holism, holding that what is a reason in one case need not be any reason in another, and maintaining that moral reasons are no different in this respect from others. He puts forward a distinctive form of value-holism to go with the holism of reasons, and he gives a detailed discussion, much needed, of the currently popular topic of 'contributory' reasons. Opposing positions of all sorts are summarized and criticized. Ethics Without Principles is the definitive statement of particularist ethical theory, and will be required reading for all those working on moral philosophy and ethical theory.

Available in PDF, EPUB and Kindle. Book excerpt: This book discusses how digital inequalities today may lead to other types of inequalities in the Global South. Contributions to this collection move past discussing an access problem – a binary division between ‘haves and have-nots’ – to analyse complex inequalities in the internet use, benefits, and opportunities of people in the Global South region. Using specific case studies, this book underlines how communities in the Global South are now attempting to participate in the information age despite high costs, a lack of infrastructure, and more barriers to entry. Contributions discuss the recent changes in the Global South. These changes include greater technological availability, the spread of digital literacy programs and computer courses, and the overall growth in engagement of people from different backgrounds, ethnicities, and languages in digital environments. This book outlines and evaluates the role of state and public institutions in facilitating these changes and consequently bridging the digital divide.
