Book excerpt: La preocupación por lograr una adecuada protección de ciertos valores humanos ha llevado a una lucha por los derechos y su reconocimiento, garantía e implementación. El llamado fenómeno de la expansión o proliferación de los derechos, posterior al final de la segunda guerra mundial, ha generado el reclamo de nuevos derechos individuales y colectivos y ha logrado plasmar muchos de ellos tanto en convenios y tratados internacionales como en leyes domésticas. Hablar de derechos se ha convertido en algo cotidiano, pero la forma en que hablamos de los derechos depende mucho del rol histórico que han tenido algunas teorías y concepciones defendidas por juristas y filósofos. Hoy en día conviven diversas concepciones de los derechos que, en buena medida, determinan las formas en que se habla de ellos y las barreras de comunicación entre distintos grupos de hablantes (abogados, políticos, internacionalistas, ONGs, etcétera). El propósito de este libro es analizar algunos aspectos importantes de este lenguaje, específicamente problemas conceptuales como las nociones de derechos subjetivos, derechos morales, derechos sociales y derechos colectivos, entre otros, relevantes en el lenguaje de los derechos. Se afirma que los problemas conceptuales y teóricos tienen implicaciones prácticas importantes a la hora de intentar proteger y garantizar los derechos, de modo que preocuparse por este tipo de cuestiones es algo más que un lujo intelectual. En este trabajo se defiende una visión unificada de los derechos que dé cuenta de cómo son usados tanto en el contexto jurídico como en el ámbito de la moral y la política.

Para ello, la autora, que formó parte del equipo de trabajo de la investigación que desembocó en “El Oasis de la Memoria”, analiza en detalle 95 casos de desaparición forzada, 86 de ellos recogidos en dicha publicación y los nueve restantes, en “Meheris: la esperanza posible”. La investigadora indica que es necesaria “una voluntad política real por transformar la realidad y romper con el pasado de violaciones de derechos humanos” y denuncia que “no se haya respetado el derecho de las víctimas a la verdad”. Los resultados del trabajo, según apunta López, se espera que sirvan para que las personas afectadas puedan defender sus derechos ante las instancias internacionales y la Audiencia Nacional española.
