El divorcio no judicial no solo supone la disolución del vínculo matrimonial, sino también la necesidad de reestructurar las relaciones entre los cónyuges (régimen económico del matrimonio, alimentos, etc.). Hoy día la concreción de tales aspectos se ve dificultada por la incidencia de distintos instrumentos normativos (Derecho institucional, Derecho convencional y estatal) tanto por lo que respecta a la competencia judicial internacional como en relación con la ley aplicable y la eficacia extraterritorial de decisiones. El aplicador del Derecho se enfrenta, en efecto, a una fragmentación de fuentes que supone un plus de dificultad, pues ha de determinar en cada caso la normativa aplicable. El objeto del presente trabajo es ofrecer una visión completa de la regulación jurídica en el Derecho internacional privado español del divorcio no judicial, lo que implica analizar los problemas de competencia internacional -e interna-, de ley aplicable y de eficacia extraterritorial, que presenta esta institución en nuestro país de forma clara y accesible, con un análisis exhaustivo de Derecho comparado y jurisprudencial, orientado a la realidad. Proporciona las claves necesarias al aplicador del Derecho, que se enfrenta a una fragmentación de fuentes, para determinar en cada caso la normativa aplicable.--
