Sin embargo, para identificarlos es necesario comprenderla estructura, la normatividad aplicable, la forma de resolución de conflictos, la manera en que se otorgan y se hacen exigibles las prestaciones de parte de los usuarios y sus derechos y deberes, para que con estas bases el lector por sí mismo pueda identificar dónde nacen las falencias. A más de lo anterior, como se refleja en la gran cantidad de disposiciones relacionadas en la bibliografía, las normas del sistema se encuentran bastante dispersas, lo cual dificulta aún más su entendimiento por la imposibilidad de analizarlas como un conjunto unificado. Las razones expuestas constituyeron la principal motivación para elaborar un manual básico que tiene como objetivo identificar la regulación y la jurisprudencia vigentes sobre el Sistema General de Seguridad Social en Salud, para brindarle al lector una visión integral de él. El texto pretende explicar de manera sencilla los aspectos básicos del Sistema corno los principios, los actores, la estructura, los regímenes, la afiliación, la cotización, las prestaciones tanto asistenciales como económicas, los trámites, las vicisitudes que puedan presentarse y los mecanismos con que cuentan los integrantes para su solución.

Book excerpt: Both developing and developed countries face an increasing mismatch between what patients expect to receive from healthcare and what the public healthcare systems can afford to provide. Where there has been a growing recognition of the entitlement to receive healthcare, the frustrated expectations with regards to the level of provision has led to lawsuits challenging the denial of funding for health treatments by public health systems. This book analyses the impact of courts and litigation on the way health systems set priorities and make rationing decisions. In particular, it focuses on how the judicial protection of the right to healthcare can impact the institutionalization, functioning and centrality of Health Technology Assessment (HTA) for decisions about the funding of treatment. Based on the case study of three jurisdictions – Brazil, Colombia, and England – it shows that courts can be a key driver for the institutionalization of HTA. These case studies show the paradoxes of judicial control, which can promote accountability and impair it, demand administrative competence and undermine bureaucratic capacities. The case studies offer a nuanced and evidence-informed understanding of these paradoxes in the context of health care by showing how the judicial control of priority-setting decisions in health care can be used to require and control an explicit scheme for health technology assessment, but can also limit and circumvent it. It will be essential for those researching Medical Law and Healthcare Policy, Human Rights Law, and Social Rights.

Cancer Intersections is an ethnographic analysis of the complex and paradoxical efforts to access neoliberal, market-based oncological treatments in Colombia, a country where all patients are legally guaranteed access to medical services, including high-cost ones. Drawing on years of fieldwork in the city of Cali, Camilo Sanz explores the deep entanglements between medical, legal, and policy practices that share a common goal of treating and curing cancer but are hindered by bureaucratic procedures, pernicious financial interests, and class politics. Cancer Intersections shows how the interplay of these hurdles dictates the rhythm at which patients access treatment and how even in resource-rich settings, patients suffer because of market imperatives that shape how cancer treatments unfold. Through careful and measured observation, Sanz unveils how a neoliberal universal health care regime delays access to care for those reliant on public assistance, which means that some patients will start expensive treatments only after it is unlikely to change the course of the disease.
