Book excerpt: El riesgo de admisión de una prueba obtenida con vulneración de derechos fundamentales se encuentra presente en nuestro proceso penal, y la deficiente cobertura legal de determinados actos de investigación pone en entredicho las garantías del ciudadano. Este peliro en torno a la ‘Eficacia de la prueba ilícita en el proceso penal’ se ha incrementado a partir de la STC 81/98, de 2 de abril, por introducir ciertos criterios más laxos en la interpretación de la doctrina de “los frutos del árbol” y por encontrar vías de posible subsanación de aquellas pruebas derivadas de un acto originario ilícito y vulnerador de un derecho fundamental del sujeto investigado. Este trabajo demuestra, a través de un análisis comparativo de la jurisprudencia del Tribunal Supremo Federal norteamericano y de nuestro Tribunal Constitucional, que estamos siguiendo los mismos pasos dados hasta ahora en dicho sistema y se está generando el denominado ‘desmantelamiento’ de dicha doctrina anglosajona en detrimento, por tanto, de nuestro sistema de garantías procesales en los actos de investigación.

Book excerpt: Esta obra se orienta a determinar la forma como debe ser aplicada la regla de exclusión de la prueba ilícita en el ámbito de la actuación civil, institución que si bien ha tenido un amplio desarrollo en el contexto del proceso penal. en el proceso civil no ha tenido tal cobertura. Para este propósito se analizó la evolución jurisprudencial y doctrinal que en punto de los mecanismos de supresión probatoria se han utilizado en los diversos sistemas jurídicos y que se mueven en el régimen de las nulidades procesales, característico de los procesos civiles en los modelos del civillaw, y el de la regla de exclusión, propio de los sistemas anglosajones del common law. Con base en esta consideración, el autor demuestra cómo, con motivo de la reforma Constitucional acontecida en Colombia en 1991, el régimen de las nulidades amplió su espectro a propósito de la inserción del inciso final del artículo 29 de dicha normativa, y ello incidió de igual manera en la forma como se deben concebir los mecanismos de supresión en ese contexto constitucional, para concluir, como en efecto se hace en la tesis, que en nuestro país se incorporó el régimen de supresión probatoria de la regla de exclusión y que es aplicable en el ámbito del proceso civil. en la medida en que aquel régimen coexiste con el de las nulidades procesales, y que a partir de los principios que caracterizan a este tipo de actuación procesal no es posible dar aplicación a los criterios atemperadores del efecto reflejo de la prueba ilícita, propios del proceso penal: vale decir, el vínculo atenuado, la fuente independiente y el descubrimiento inevitable.

The piercing of the corporate veil is a remedy applied, in exceptional circumstances, to prevent and punish an inappropriate use of the corporate personality. The application of this remedy and the issues it involves has been widely researched in Anglo-American jurisdictions and, until recently, little attention has been given to this subject in Latin America. This region has been through internal political conflicts that undermined economic development. However, rise of democratic governments has created the political stability necessary for investment and economic development meaning that the corporate personality is now more commonly used in Latin America. Consequently, corporate personality issues have become a subject of study in this region. Drawing on case studies from Mexico, Colombia, Brazil and Argentina, Piercing the Corporate Veil in Latin American Jurisprudence examines the ingenuity of Latin American jurisdictions to deal with corporate personality issues and compares this method with the Anglo-American framework.
