E-waste management is a global concern and it becomes a priority as the world experiences tremendous technological innovations, countries are being forced to develop and adopt new models for the collection and environmentally sound disposal of this waste. In Tanzania there is no specific legislation with regards to the management of e-waste disposal; its legal setting through EMA covers the issue of e-waste disposal in a general context. It clusters e-waste together with other solid waste. The Act doesn’t have any specific provisions on e-waste. The Act under Part IX considers e-waste in general context as hazardous waste thus making its regulation and management ineffective. This research tests the hypothesis on whether there is a legal lacuna with respect to statutory and regulatory framework dealing with e-waste disposal in Tanzania, whether statutory and regulatory framework in Tanzania, with regards to e-waste disposal is sufficient and effective in protecting, preventing and controlling e-waste disposal in Tanzania and whether the establishment of specific e-waste policy and enactment of specific legislation regarding e-waste disposal in Tanzania would amount to equitable solution over e-waste management. The main objective of the study is to identify legal lacuna that exist on the management e-waste disposal in Tanzania, to make an analysis of the statutory and regulatory framework with regards to e-waste disposal and to recommend establishment of effective legislation with regards to e-waste management in Tanzania. In realizing the objective; the research and made extensive analysis of legal framework on management of e-waste disposal; and various findings are discussed in connection with the interviews and questionnaire and in the final end the research recommends establishment of e-policy, regulatory authority and enactment of specific policy to cover for the management of e-waste disposal.

Book excerpt: Information technology has proliferated over the past two decades, and waste from electronics represents the fastest growing waste stream in the world. The production and disposal of electronics, from cradle to grave, pose critical threats to human health and the environment. The management of electronic, or e-waste, streams poses a particular set of challenges for solid waste management, hazardous waste management, and economic development in the United States. As e-waste accumulates, state governments, municipalities and private landfills are refusing to accept the responsibility for its disposal. To address this problem, the federal and state governments must find a safe and economically feasible way to process e-waste. This thesis analyzes the lessons learned from both the European Union’s e-waste programs and from a set of US e-waste cases. These range from state-led e-waste programs to manufacturer-led and voluntary e-waste programs. Based on this comparative case method, a set of key barriers emerge in the US cases that undermine e-waste management policies: the perception that US manufacturers will recycle electronic products properly, the power of the electronics industry to block policies, the lack of public consumer education about the environmental consequences of e-waste disposal, and the fact that recycling e-waste is more expensive than extracting raw materials. These factors reflect political and socio-economic realities within the US, including the power of the electronics industry, the perceived capacity of municipal solid waste systems, and the salience and the perception of consumers that US federal laws appropriately manage e-waste disposal. Part of the issue is that e-waste falls into regulatory gaps across major waste management federal laws. This thesis argues that state-led e-waste management policies are not adequate because of the lack of cooperation from all e-waste stakeholders from the federal government, state government, electronics industry, third party processors, and consumers.

Growth of international trade of hazardous and non-hazardous waste brings about need to reconceptualise economic activity as multi-directional with a complex set of actors and regimes of value involved. Consequently, this thesis addresses the role of e-waste in secondary economies and mechanisms which enable waste to transform into resource. The lack of transparency overlapping with the issue of informality in waste management practices makes e-waste peculiarly difficult to govern. Based on the global production network approach, the thesis conceptualises e-waste issue by analysing the multi-layered networks of actors and the power distribution and embeddedness of actors and institutions in production networks. These conceptual elements are applied with the analysis of risk-resource duality of e-waste, which in different spatial contexts means that transformation from waste to resource is dependent on regulatory measures taken within a particular network. Empirically, the thesis analyses the international, regional and national regulations on e-waste with a view of determining their overlap, applicability and reach. The regulatory framework is then assessed on case studies of Slovenia and Bosnia and Herzegovina and their national e-waste management systems and trade practices. The thesis demonstrates the narrow, limited applicability of current regulation regime in dealing with complexity of e-waste issue. In doing so, the thesis highlights the failure of regulations to address the multi-directional nature of trade flows, relying on the oversimplified North-South split narrative.

Abstract: This study compares the procedures of formal and informal e-waste recycling; and investigates the relationship between informal e-waste recycling and the health of residents living near the recycling facilities. The informal e-waste recycling facilities are mainly located in developing countries and are operated by illegally receiving e-waste from developed countries. In these informal recycling businesses, the procedures are raw and crude without any measures in pollution control and state-of-the-art technologies, suggesting the health of the workers and residents living nearby are at risk. By conducting human health risk assessment based on the data from Guiyu town located in China, the actual exposure level of PCDD/Fs for infants is estimated. The total exposure level of infants to PCDD/Fs in Guiyu is 61.5 pg WHO-TEQ 〖kg〗 DEGREES(-1) 〖day〗 DEGREES(-1); among the total exposure level, dietary route accounts for over 90%. The total exposure value has also exceeded the WHO standards by 61 times at most, which reflects a harmful level of local PCDD/Fs exposure to the infants and management measures are needed. Implication can be drawn that not only the infants, but also people living near the facilities of informal e-waste recycling, including the mothers and residents are under high level of exposure to PCDD/Fs and other hazardous chemicals presented in the recycling process. Management and regulations are the weaknesses of developing countries to handle the issues on e-waste. The study reviews the e-waste management and regulations in China, India and Nigeria; their common properties have been revealed, including the lack of enforcement and the misconceptions of e-waste. Regarding the national level of regulations and legislations, recommendations have been drawn. Measures in adopting licensing system for recycling business, adopting financial mechanism on top of the existing the Extended Producer Responsibility (EPR) system to limit the use of hazardous chemicals, setting up special department for better regulating and enforcing e-waste related issues and enhancing the public education towards e-waste are of benefits. The study suggests an action plan using China as an example to illustrate how the country could act upon the existing regulations and legislations of e-waste issues.
