Book excerpt: The National Highway Traffic Safety Administration (NHTSA) developed an assessment process that gives States an opportunity to conduct a review of their efforts to control impaired driving by an outside team of nationally recognized experts. Each assessment examines a State's overall program and presents recommendations to improve or enhance it. NHTSA reviewed 38 State assessment reports and found 2,982 individual recommendations, including 852 that were identified as priority recommendations by the teams. Most of the recommendations fit into 10 thematic areas: (1) increasing deterrence by prioritizing enforcement efforts and enhancing the arrest, prosecution, and adjudication process; (2) improving public information and education efforts related to prevention and deterrence; (3) remedying problems involving DUI data and records (reporting requirements, offender tracking systems, data linkages, uniform traffic citations); (4) enacting new laws or revising existing laws aimed at increasing the deterrence and/or prevention of DUI; (5) enhancing training for law enforcement, prosecution, and judicial personnel; (6) evaluating programs and activities to combat impaired driving; (7) providing sufficient resources for treatment and rehabilitation; (8) improving inter/intra-governmental coordination and cooperation; (9) providing funding (including self-sufficiency) to provide for adequate resources (personnel, equipment); and (10) developing or increasing task forces and/or community involvement.

Our knowledge of drunken driving is much more comprehensive than drugged driving, so a large part of this book is devoted to alcohol impairment, as well as impairment caused by use of drugs other than alcohol. For convenience, the book is divided into four main sections. The first section gives some historical background about measuring alcohol in blood and breath as evidence for the prosecution of traffic offenders. The important role of the Breathalyzer instrument in traffic-law enforcement, especially in Australia, Canada, and the USA is presented along with a biographical sketch of its inventor (Professor Robert F. Borkenstein of Indiana University) with focus on the man, his work and his impact. The second section discusses several issues related to forensic blood and breath-alcohol alcohol analysis as evidence for prosecution of traffic offenders. This includes how the results should be interpreted in relation to impairment and an evaluation of common defense challenges. Because most countries have adopted concentration per se laws, the main thrust of the prosecution case is the suspect’s measured blood- or breath-alcohol concentration. This legal framework necessitates that the analytical methods used are "fit for purpose" and are subjected to rigorous quality assurance procedures. The third section gives a broad overview of the current state of knowledge about driving under the influence of non-alcohol drugs in various countries. This includes adoption of zero-tolerance laws, concentration per se statutes, and clinical evidence of driver impairment based on field sobriety tests and drug recognition expert evidence. The fourth section deals with epidemiology, enforcement, and countermeasures aimed at reducing the threat of drunken and drugged driving. All articles have appeared previously in the international journal Forensic Science Review, but all are completely updated with current data, references, and the latest research on developments since the articles were published. They claim otherwise, of course, and deny that they have any interest at all in profit, and that their only goal is to protect the general public from dangerous drivers. The author, George Damusis, reveals the deceitfulness of that claim, given that the vast majority of DUI arrests are of common, decent social drinking citizens, who caused no harm. He was one of them, and now argues with great conviction that it's a form of tyranny and a violation of human rights to arrest, criminalize, extort, and virtually enslave decent citizens for a year just for drinking moderately before driving. He calls attention to the unbiased traffic accident research compiled over many years that proves that moderately intoxicated drivers cause no more accidents than alcohol free drivers. So, what rule of logic then allows law enforcement to declare these common citizens to be criminals? He claims instead that all those cavalier and unnecessary DUI arrests made by profit motivated police are the real crime. While Mr. Damusis does agree that the best and most rational safety policy is to not drink any alcohol at all before driving, he also insists that those who do drink in moderation before driving are not criminals by any stretch of the imagination. They are, after all, doing only what millions of social drinking drivers do so naturally every weekend in this our government sanctioned, alcohol permissive culture. These common citizens are charged with an actual crime simply to make it legal to arrest and fine them repeatedly. It's clearly a case of policing for profit, and not a case of policing for public safety. Mr. Damusis is not a law professional, and received no professional mentoring in the writing of this book. His arguments are a product of his personal experiences, the experiences of others, and his serious internet research. This book severely criticizes our oppressive DUI laws and DUI enforcement policies, but also offers constructive proposals for bringing moral reform to the entire DUI law enforcement system.
