Book excerpt: Gaius Meets Cicero. Law and Rhetoric in the School Controversies sheds new light on a much debated issue in the field of Roman law, i.e. the so-called 'school controversies' between the Sabinians and the Proculians. Tessa Leesen rejects the general assumption in modern literature that the two schools each adhered to a fundamentally different theoretical conception of law. She argues that the 'school controversies' as described in Gaius' Institutiones arose in legal practice when the heads of the two schools were consulted by two conflicting parties and each gave opposing advice. In order to make their opinions persuasive, the jurists were in need of adequate arguments. For this purpose, they made use of rhetoric and of the argumentative theory of topoi as described in Cicero's Topica.

Book Synopsis Encyclopedic Dictionary of Roman Law by : Adolf Berger
Download or read book Encyclopedic Dictionary of Roman Law written by Adolf Berger and published by American Philosophical Society. This book was released on 2024-04 with total page 498 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Dictionary: explains technical Roman legal terms, translates & elucidate those Latin words which have a specific connotation when used in a juristic context or in connection with a legal institution or question, & provides a brief picture of Roman legal institutions & sources as a sort of an introduction to them. The objectives of the work, not the juristic character of available Latin writings, therefore, determined the inclusion or exclusion of any single word or phrase. This dict. is not intended to be a complete Latin-English dict. for all words which occur in the writings of the Roman jurists or in the various codifications of Roman law. The reader must consult a general Latin-English lexicon for ordinary words that have no specific meaning in law or juristic language. Reprinted 1980.

Book Synopsis Roman Private Law Around 200 B.C. by : Alan Watson
Download or read book Roman Private Law Around 200 B.C. written by Alan Watson and published by . This book was released on 1971 with total page 208 pages. Available in PDF, EPUB and Kindle. Book excerpt: Around 200 BC Rome which had been the greatest force in Italy became the greatest power in the Mediterranean. The law of the time stands poised between the archaic rules of the XII Tables of 451 BC and the complex flexible system of the very late Republic. The general picture of this law and much detail can be reconstructed both from the rather scanty direct evidence and from earlier and later materials. That odd combination of sophistication and crude vigour, so charecteristic of the period, is as visible in the law as in the wars of conquest and the plays of Palutus. The author has devoted more than ten years of research to the elucidation of private law in the last two centuries of the Roman Republic and has published his conclusions in several books and articles. Here he presents the law as it was at the bebinning of that period.

Book Synopsis Classical Rhetoric in the Middle Ages by : John O. Ward
Download or read book Classical Rhetoric in the Middle Ages written by John O. Ward and published by BRILL. This book was released on 2018-12-24 with total page 724 pages. Available in PDF, EPUB and Kindle. Book excerpt: Classical Rhetoric in the Middle Ages: The Medieval Rhetors and Their Art 400-1300, with Manuscript Survey to 1500 CE is a completely updated version of John Ward’s much-used doctoral thesis of 1972, and is the definitive treatment of this fundamental aspect of medieval and rhetorical culture. It is commonly believed that medieval writers were interested only in Christian truth, not in Graeco-Roman methods of ‘persuasion’ to whatever viewpoint the speaker / writer wanted. Dr Ward, however, investigates the content of well over one thousand medieval manuscripts and shows that medieval writers were fully conscious of and much dependent upon Graeco-Roman rhetorical methods of persuasion. The volume then demonstrates why and to what purpose this use of classical rhetoric took place.

Book excerpt: The Institutes are a complete exposition of the elements of Roman law and are divided into four books—the first treating of persons and the differences of the status they may occupy in the eye of the law; the second-of things, and the modes in which rights over them may be acquired, including the law relating to wills; the third of intestate succession and of obligations; the fourth of actions and their forms. For many centuries they had been the familiar textbook of all students of Roman law.
