The long-awaited "Part 107" regulations for small unmanned aircraft systems - or "sUAS" - went into effect on August 29, 2016. Though there are still many questions about these regulations, at least they are in effect. Until they were in place, any commercial drone activity required a special exemption from the FAA. Without the exemption, no one could legally fly. Things are different now. Today, commercial drone operators have a clear path to operating legally under the FAA regulations. This means that many new companies are going to start flying, nationwide. When more drone entrepreneurs start flying under the new federal regulations, the practical effects of state laws that have been passed over the years will become clear. Legislative ideas that looked desirable to some when the drone industry was small may begin to hurt real businesses. This will happen in every state. During that time, the substantive legal privacy framework relating to UAS on the federal level has remained relatively static: Congress has enacted no law explicitly regulating the potential privacy impacts of drone flights, the courts have had no occasion to rule on the constitutionality of drone surveillance, and the Federal Aviation Administration (FAA) did not include privacy provisions in its proposed rule on small UAS. This issue, however, has not left the national radar. Congress has held hearings and introduced legislation concerning the potential privacy implications of domestic drone use; President Obama recently issued a directive to all federal agencies to assess the privacy impact of their drone operations; and almost half the states have enacted some form of drone legislation. This book provides a primer on privacy issues related to various UAS operations, both public and private, including an overview of current UAS uses, the privacy interests implicated by these operations, and various potential approaches to UAS privacy regulation.

The results are quite telling: as of April 2016, 73% of ACP countries did not have any rules or regulations in place; 19% had some regulations in place; and 8% were in the process of formulating them. The data gathered in the course of the study have been published on a site hosted by The Swiss Foundation for Mine Action (FSD) and are accessible at www.droneregulations.info. CTA hopes that this database will help to increase awareness of the rules and regulations surrounding UAV use, promote their responsible use and help to fully realise their potential in the management of crops, fisheries and other resources.
