En particulier, l'apparition du Web 2.0 a bouleversé le comportement des intermédiaires techniques et des utilisateurs, rendant ainsi inadaptées les règles existantes en matière de responsabilité numérique. Les publications de presse sont en effet agrégées et traitées par des plateformes numériques, ce qui génère une valeur importante grâce notamment à la publicité et au traitement des données personnelles. Cette valeur est en pratique accaparée par les infomédiaires1, en particulier les GAFAM2. Les éditeurs en revanche ne perçoivent qu'une infime partie de la valeur générée par ces contenus alors qu'ils ont investi et contribuent de manière financière et organisationnelle à la création de ces publications de presse. La Directive européenne sur le droit d'auteur et les droits voisins dans le marché unique numérique3, adoptée le 17 avril 2019, a pour objectif de rééquilibrer cet écart de répartition de valeur, appelé Value Gap, entre les acteurs de la création et de son partage. Elle a fait le choix d'instaurer un droit voisin au profit des éditeurs et des agences de presse, en laissant une marge de manoeuvre aux États membres et au juge pour en déterminer plus précisément les contours. Une proposition de loi de transposition4 est actuellement en discussion devant le Parlement français, déposée le 5 septembre 2018, afin de transposer de manière fidèle ce droit voisin. L'efficacité et l'effectivité de ce nouveau droit voisin ne pourront être garantie que si ses exceptions sont précisées par le juge conformément à l'intention des législateurs français et européen, afin de garantir un juste équilibre entre droit de propriété intellectuelle et liberté d'expression.
