Book excerpt: Depuis quelques années, les revendications politiques et territoriales des Autochtones posent le problème de la place de ces peuples dans l’État canadien et québécois issu de la colonisation européenne du territoire. Les mutations constitutionnelles récentes, les décisions des tribunaux et la négociation d’ententes historiques entre le Canada, le Québec et les peuples autochtones annoncent des bouleversements dont il est devenu impérieux de prendre la juste mesure. Le défi consiste à donner sa pleine effectivité à la reconnaissance des droits des peuples autochtones dans un pays qui, pendant des décennies, voire des siècles, s’est développé en faisant largement abstraction des Autochtones et de leurs droits. Pour relever ce défi, il faut d’abord comprendre d’où viennent ces droits et en connaître la raison d’être. Il faut aussi composer avec la difficulté d’interpréter aujourd’hui ces droits en l’absence de textes clairs ou actuels en définissant la portée. Il importe enfin de savoir tenir compte du point de vue et des besoins légitimes des Autochtones sans pour autant occulter la nécessité d’une cohabitation de tous les citoyens au sein d’une société plurielle qui dépend, pour son développement, d’un accès aussi bien durable qu’équitable aux ressources d’un vaste territoire. Dans cet ouvrage, qui est en grande partie le prolon-gement du colloque Les droits des Autochtones : réalités et mythes tenu à l’Université Laval le 25 avril 2003, des juristes spécialistes de la question autochtone expliquent les origines et les justifications historiques des droits ancestraux et issus de traités. Ils se penchent aussi sur les difficultés propres à la définition contemporaine des droits collectifs des premières nations devant les tribunaux ou lors de négociations de traités modernes. Ils montrent enfin en quoi ces droits collectifs, dont le droit à l’autonomie gouvernementale, soulèvent des enjeux inédits de gouvernance tant dans les rapports entre les ordres de gouvernement au sein du régime fédéral canadien que dans les relations entre les droits de groupe et les libertés individuelles garanties dans les Chartes des droits. Les droits territoriaux des autochtones ne peuvent être assimilés à la propriété privée ; ce sont des droits " ancestraux " qui trouvent leur source dans l'occupation immémoriale du territoire et les systèmes juridiques proprement autochtones. La technique du traité, un instrument juridique original qui n'est ni un simple contrat ni un traité international, a été utilisée dès les premiers contacts entre Européens et autochtones et sert encore de nos jours à définir les conditions de la coexistence entre les deux groupes. Mais c'est l'évolution du statut politique des autochtones qui est la plus remarquable : considérés il y a un demi-siècle comme des pupilles de l'État, les autochtones jouissent maintenant d'un droit à l'autonomie gouvernementale dont on commence à peine à entrevoir la portée. On assiste donc à une transformation graduelle du fédéralisme canadien pour faire une place à ce " troisième ordre de gouvernement " que constituent les autochtones.

In this book, Robert Mainville examines Aboriginal and treaty rights in an historical and legal context, explaining their origins and reviewing major court decisions that have defined Aboriginal rights. The author points out that Aboriginal rights include more than Aboriginal title, and stresses the fiduciary relationship between the federal government and Aboriginal peoples. He also discusses the impact of the Canadian constitution on Aboriginal rights, and the limits to the government's ability to infringe upon Aboriginal and treaty rights. The heart of this book deals with the complex question of compensation for the infringement of Aboriginal and treaty rights. The author begins with the Canadian law of expropriation but argues that, while these principles can provide guidelines for compensation, expropriation law is inadequate to address the issue fully. He then examines American jurisprudence and concludes that the American experience, which involves complex legal maneuverings and narrowly applied principles, has not always led to justice for Native Americans. Against this background, Mr. Mainville sets out clear and practical principles for determining appropriate compensation when Aboriginal or treaty rights are breached. These principles include: considering the government's fiduciary obligation; applying uniform compensation principles across the country; adequately assessing the impact of the breach on the Aboriginal community as a whole; considering the benefits derived by the Crown and third parties; the need for structured compensation schemes that do not necessarily meet mathematically accurate tests; and assessing third party responsibility for compensation.
