Book excerpt: Le droit et l’intégration des énergies renouvelables dans le bâtiment, dans un contexte politique favorable au développement durable et à la diminution de la production des gaz à effet de serre, entretiennent des rapports étroits qui nous conduisent à aborder les règles incitant à leur mise en place -cependant freinée à certains égards-, mais également les dispositifs juridiques encadrant l’utilisation de ces systèmes producteurs d’énergie. L’intégration des énergies renouvelables vise, dans le cadre de cette étude, les équipements fournissant de l’énergie électrique par des systèmes photovoltaïques, la production d’eau chaude par les panneaux solaires, et la géothermie. Les différents dispositifs tels que l’obligation de rachat, les incitations fiscales et subventions, les certificats, les labels, la réglementation thermique et le DPE, paraissent dans leur ensemble bien intégrés dans le système juridique français malgré quelques imperfections. En revanche, le droit de l’urbanisme ainsi que l’intervention des ABF se profilent en véritable frein pour un développement exponentiel. Nous démontrons que les règles juridiques ayant un impact direct sur la gestion relèvent principalement du droit de la copropriété ainsi que du droit des baux. La mise en place de tels équipements en copropriété n’est pas aisée, elle ne l’est pas plus lorsque le bien est soumis à une location. Si on peut souligner qu’en matière de louage la principale difficulté réside dans le paiement de l’énergie par le locataire, qui peut semble-t-il, être solutionnée simplement ; il n’en est pas de même en matière de copropriété où les difficultés se cumulent. Pour une vision d’ensemble opportune, il convient de rappeler que la mise en place des équipements fournissant de l’énergie renouvelable dans les bâtiments va certainement induire une garantie décennale couverte par la responsabilité des constructeurs et particulièrement l’assurance dommages-ouvrage.

As regards conflict, 2000 saw the Middle East peace process grind to a halt, and the Intifada resume. In Europe, the situation in Kosovo and Chechnya, both the scenes of fighting in 1999, stayed precarious. Peace and democracy did score some successes, however, particularly in Europe: the centre-left's victory in Croatia, sweeping former President Tudjman's party off the scene, the democratic party's triumph in Bosnia, and the fall of the Milosevic regime in Serbia.
