Book excerpt: The UK established the world's first animal welfare protection laws, with the passing of the Protection of Animals Act in 1911 which made it an offence to cause unnecessary suffering to any domestic or captive animal. This draft Bill, which extends to England and Wales, seeks to consolidate and modernise the legislation in line with current animal welfare standards, including the reforms undertaken in other countries such as New Zealand and Sweden. Amongst its provisions, which are grouped under 10 headings, the draft Bill seeks to: i) establish a duty of care to ensure the welfare of all kept animals, enabling animal welfare organisations to intervene where there is evidence an animal is being kept in conditions likely to lead to suffering, rather than having to wait for evidence that the animal has suffered abuse before legal action can be taken; ii) prohibit the sale of pets to children under 16; iii) end the practice of giving pets, including goldfish, as prizes, for example at funfairs; and iv) make offences of animal cruelty or keeping animals for fighting arrestable offences, with the maximum penalty leading to imprisonment upto 51 weeks or a fine of upto £20,000, or both. The White Paper itself had proposed a strategic system of marine planning to balance conservation, energy and resource needs, using the principle of sustainable development. The Draft proposals in this Bill puts the earlier proposals of the White Paper into a legislative framework, which includes: the creation of the Marine Management Organisation; deliverance of new marine planning systems, including establishing new powers to enable the Government to put in place a network of marine conservation zones to protect marine life; better licensing decisions for licensing activities in the seas; reforms to a range of marine, migratory and freshwater fisheries management arrangements; allow greater access to the English coast. Book excerpt: In this monograph, Aistė Mickonytė examines the compliance of the European anti-cartel enforcement procedure with the presumption of innocence under Article 6(2) of the European Convention on Human Rights (ECHR). The author maintains that the pursuit of manifestly severe punishment with insistence of the European Commission on administrative-level procedural safeguards is inconsistent with the robust standards of protection under the Convention. Arguing that EU anti-cartel procedure is criminal within the meaning of the Convention, this work considers this procedure in light of the core elements of the presumption of innocence such as the burden of proof and the principle of fault. The author zeroes in on the de facto automatic liability of parental companies for offences committed by their subsidiaries.

Book excerpt: The Better Regulation Executive and government departments are not yet in a position to achieve value for money in their management of regulation. However, the Better Regulation Executive, created in 2005, and departments have developed important elements of a structured approach to achieving sustainable reductions in regulatory costs and have delivered significant benefits. Businesses generally recognise the purpose of regulation, but they believe that it can be unnecessarily burdensome, particularly on the smallest businesses. Businesses interviewed by the NAO typically have to consider as many as 60 regulations, governed by many different regulatory bodies. Businesses, particularly small and medium enterprises, are not clear on how to comply fully with regulation. The NAO found that departments are not communicating effectively with businesses about regulation. Businesses find it difficult to keep up with the extent of new regulation and changes to legislation. The Coalition Government's programme included several commitments to regulatory reform. Departments are currently conducting evaluations of their existing regulations, but they have not been taking a systematic approach and no overall attempt has been made to review the total number of regulations that businesses face. Furthermore, there is as yet no detailed plan for achieving the new Government's regulatory reform objectives. Departments do not routinely evaluate the impact on business of regulation once it has come into effect. They are, therefore, not in a good position to make adjustments to improve regulation in light of experience.
