In this report it looks at how the principles of human rights can be applied to older people in hospitals and care homes to ensure they are treated with greater dignity and respect. It looks first at the current position before covering: the leadership of the Department of Health; the implementation of the Human Rights Act by service providers; health and social care inspectorates and NICE; the role of staff in protecting human rights; and empowering older people. It finds that, although there are examples of excellent care, there are concerns about poor treatment, neglect, abuse, discrimination and ill-considered discharge. There is a significant difference between the "duty to provide" under care standards legislation and the "right to receive" under human rights legislation and the culture needs to change. The Committee recommends legislation and a role for the Commission for Equality and Human Rights. It also recommends measures to strengthen human rights obligations and duties, including better guidance and standards, and bringing private and voluntary care homes into the scope of the Human Rights Act.

Personal data should be handled in accordance with the Data Protection Act (PGA 1998 chp. 29, ISBN 9780105429982), whilst the Human Rights Act (PGA 1998 chp. 42, ISBN 9780105442981) safeguards the right to respect personal information. The Committee has expressed concern about the recent lapses in the protection of data in particular where the sharing of information takes place, and that such sharing needs to be justifiable and appropriate. The Committee fundamentally disagrees with the Government's approach about data protection and does not agree that the two Acts offer sufficient protection, and that further primary legislation is needed to make clear the importance of data protection inside and outside government. The Committee also states that the recent lapses are indicative of a symptomatic failure within government to safeguard personal data and that human rights are far from being a mainstream consideration in Government department's. The Committee states that Government needs to set out proposals to rectify this situation. The Committee supports the extension of the Information Commissioner's powers to defend human rights, but expresses regret that it has taken the loss of personal data affecting 25 million people for the Government to take the issue of personal data more seriously. Book excerpt: The Secure Training Centre (Amendment) Rules (SI 2007/1709, ISBN 9780110773742) which amended the Secure Taining Centre Rules 1998 (SI 1998/472, ISBN 9780110656083) came into force in July 2007 without Parliamentary debate. They amend the existing Rules to permit Secure Training Centres (STCs) to use force against detained children and young people to "ensure good order and discipline". The Amendment Rules were criticised and the Government promised a review. A judicial review of the Amendment Rules by the High Court, held that they represented a "significant change in policy" The Joint Committee on Human Rights considers in this report their compatibility with the UK's human rights obligations. Restraint allowed in STCs is known as Physical Control in Care (PCC) and comprises a range of restraint holds and so called "distraction techniques" The Minister of Justice, for the Department of Justice, states the Government does not sanction violence against children, but the Committee considers that this is the effect of current UK law. In the Committee's view the Amendment Rules have created more confusion and have widened the scope for the use of force in an unacceptable manner. It recommends new Amendment Rules to make clear that physical restraint is not permissable for the purposes of good order and discipline and recommends careful monitoring of the effect of the Amendment Rules with regular reports by Government to Parliament on the number of restraint incidents. The Committee does welcome the creation of the Youth Justice Unit along with the re-establishment of the Medical Review Panel and also welcomes the Government's suspension of two restaint techniques in December 2007. The Committee further recommends the abolition of all distraction techniques and suggests a series of measures to ensure compliance by STCs with human rights standards as well as the publication of the PCC training manual in full and disseminated to all staff who use restraint.
