Questioning this assumption, the book contends that purportedly “good” rule of law standards do not always deliver benign benefits but rather often have negative consequences that harm the very local constituents which rule of law promoters promise to help. In particular, the book argues that rule of law promotion in post-colonial societies reinforces socioeconomic and political inequality which disproportionately favors dominant actors who have the wealth, education, and influence to navigate the state legal system. In addition to an historical account of legal development in settler-colonial environments, this argument is also drawn from a comparative study which focuses on the UK-supported justice sector development programs in Sierra Leone and the US-funded rule of law projects in Liberia.

In its aftermath, the financial crisis pushed to the forefront fundamental moral and institutional questions about how we govern the modern economy. What are the values that economic policy ought to prioritize? What institutions do we trust to govern complex economic dynamics? Much of popular and academic debate revolves around two competing approaches to these fundamental questions: laissez-faire defenses of self-correcting and welfare-enhancing markets on the one hand, and managerialist turns to the role of insulated, expert regulation in mitigating risks and promoting growth on the other. In Democracy Against Domination, K. Sabeel Rahman offers an alternative vision for how we should govern the modern economy in a democratic society. Drawing on a rich tradition of economic reform rooted in the thought and reform politics of early twentieth century progressives like John Dewey and Louis Brandeis, Rahman argues that the fundamental moral challenge of economic governance today is two-fold: first, to counteract the threats of economic domination whether in the form of corporate power or inequitable markets; and second, to do so by expanding the capacity of citizens themselves to exercise real political power in economic policymaking. Emphasizing the role of ideological systems in the definition of political violence, this book is theoretical, historical, and critical. Peasants, serfs, untouchables, slaves, laborers, and prisoners are not free to speak their minds in the presence of power. These subordinate groups instead create a secret discourse that represents a critique of power spoken behind the backs of the dominant. At the same time, the powerful also develop a private dialogue about practices and goals of their rule that cannot be openly avowed. In this book, renowned social scientist James C. Book excerpt: Domination and Resistance illuminates the twin themes of superpower domination and indigenous resistance in the central Pacific during the Cold War, with a compelling historical examination of the relationship between the United States and the Republic of the Marshall Islands. For decision makers in Washington, the Marshall Islands represented a strategic prize seized from Japan near the end of World War II. In the postwar period, under the auspices of a United Nations Trusteeship Agreement, the United States reinforced its control of the Marshall Islands and kept the Soviet Union and other Cold War rivals out of this Pacific region. The United States also used the opportunity to test a vast array of powerful nuclear bombs and missiles in the Marshalls, even as it conducted research on the effects of human exposure to radioactive fallout. Although these military tests and human experiments reinforced the US strategy of deterrence, they also led to the displacement of several atoll communities, serious health implications for the Marshallese, and widespread ecological degradation. Confronted with these troubling conditions, the Marshall Islanders utilized a variety of political and legal tactics—petitions, lawsuits, demonstrations, and negotiations—to draw American and global attention to their plight. In response to these indigenous acts of resistance, the United States strengthened its strategic interests in the Marshalls but made some concessions to the islanders. Under the Compact of Free Association (COFA) and related agreements, the Americans tightened control over the Kwajalein Missile Range while granting the Marshallese greater political autonomy, additional financial assistance, and a mechanism to settle nuclear claims. Martha Smith-Norris argues that despite COFA's implementation in 1986 and Washington's pivot toward the Asia-Pacific region in the post–Cold War era, the United States has yet to provide adequate compensation to the Republic of the Marshall Islands for the extensive health and environmental damages caused by the US testing programs.
