Book excerpt: While a stated goal of minimum wage increases is to benefit low-income workers, some employers are not obligated to provide at least minimum wages to all employees. U.S. farm employers comprise one of these groups. Employees of large farms and H2-A workers (temporary nonimmigrant workers lawfully admitted to perform temporary or seasonal agricultural services) are protected by minimum wage legislation, while other migrant workers (especially those who are paid piece rate) are exempt. Furthermore, U.S. agriculture is characterized by a large percentage of illegal migrants, and workers who are illegal may or may not receive wages above minimum levels. This paper presents a case study, drawing from agriculture, that examines if and how minimum wage laws affect uncovered workers. Analysis examines wages and hours worked as functions of federal and state minimum wages using data from a nationally and regionally representative survey of employed farm workers. Results suggest wage increases for both covered and uncovered workers, greatest gains to those who are formally covered, and gains not being at the expense of hours worked.

Book excerpt: Previous experimental results have shown that the introduction of a minimum wage increases wages in a monopsonistic labor market. The results rely on the assumption that the minimum wage laws are common knowledge among employers and workers, which is often violated in less developed labor markets. This paper examines the effect of asymmetric knowledge about the minimum wage, and its interaction with the level of the minimum wage standard. We find that, whether the workers have knowledge about the minimum wage significantly changes the behavioral impacts of the minimum wage policy. With common knowledge, most firms offer wages beyond the minimum wage level. When workers do not know about the minimum wage policy, many firms, including those who used to pay higher wages before the introduction of the policy, choose to pay wages at the minimum level or lower their offers toward the minimum level. This causes the introduction of the minimum wage not effective in increasing average wages when the minimum wage standard is low. Therefore, a low minimum wage under asymmetric knowledge may potentially have a negative spillover effect on wages. The asymmetric knowledge also affects the employment level negatively. These findings help explain why the impacts of minimum wage are different in labor markets where workers have different degree of information access. This has strong implications for the implementation and welfare impacts of minimum wage laws.

Book excerpt: With the passage of the Fair Labor Standards Act in 1938, Congress mandated a federal “living wage” in order to “maintain the minimum standard of living necessary for the health, efficiency, and general well-being of workers.” Advocates have long insisted that increases in the minimum wage result in a net gain to employees' standard of living. Critics have countered that those gains come at the expense of higher prices and shrinking overall employment numbers, leaving a new class of potential workers out in the cold.This Article synthesizes the empirical economic impact data from minimum wage increases over the past several decades and compares the results to the recent aggressive efforts being made at the local level in major cities like Seattle, Chicago, Los Angeles and San Francisco. Economic analysis reveals that while employment losses were relatively significant from raises in the minimum wage increases thirty years ago, those job losses were much smaller with subsequent wage hikes in the past two decades - i.e., the net gains to the working class have outweighed the costs. This Article offers theories to explain why that is so: for one, employees are more productive due to technological advancements than they were decades ago, and second, the federal minimum has fallen further and further behind the average national wage (so that increases affect relatively few workers). This Article analyzes whether the same net benefits to the working class are likely to accrue with the very recent push to a $15 minimum wage in cities like Seattle and San Francisco and major states like New York and California. The initial data paint a cautiously optimistic picture, indicating that job losses (and product-price increases) from these aggressive minimum wage laws have not been prohibitive, but that they do exist and are certainly worth monitoring. Finally, this Article proposes several normative policy mechanisms to facilitate a smoother transition to a newly revamped minimum wage nationwide.

We examine the impact of state minimum wage increases on employer health benefit offerings using the 2002-2020 Medical Expenditure Panel Survey - Insurance/Employer Component data. Our primary regression specifications are difference-in-differences models that estimate the relationship between within-state changes in employer-sponsored insurance and minimum wage laws over time. We find that a $1 increase in minimum wages is associated with a 0.90 percentage point (p.p.) decrease in the percentage of employers offering health insurance, largely driven by small employers and employers with more low-wage employees. A $1 increase is also associated with a 1.80 p.p. increase in the prevalence of plans with a deductible and three percent increase in average deductibles. We do not find consistent evidence that other benefit characteristics are affected. We find no consequent change in uninsurance, likely explained by an increase in Medicaid enrollment.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law.
