Book excerpt: This study provides a detailed study of the fishing nation of Taiwan at a regional and local level in order to address the lack of academic research into the Taiwanese fishing industry in comparison to other nations. Over three stages of analysis it identifies the reasons for the rise and decline of Taiwanese distant-water fisheries. The first stage examines the broader historical background, government policy, and birth of the Taiwanese fishing industry. The second explores the industry at a national level, analysing the relationships between fishing, government, military, and ancillary industries. The third approach narrows the scope to individual fishing communities and explores the working lives and cultural habits of the fishermen. The major focus is the port of Kaohsiung and how it became the major supply base for the fishing industry. It explores Taiwan’s relationship with Japan and the postwar decline due to Japan’s losses in the Second World War. Finally, it considers the development of Taiwanese colonial and postwar fishing policies. It concludes that modern fishing techniques were introduced from Japan, and emboldened Taiwanese fisherman to risk entering remote and foreign waters. The author suggests that further research into Taiwan take would help scholars better understand the history of distant-fisheries. The journal consists of nine chapters, an introduction and conclusion, a list of interviewees, and a bibliography of English and Chinese-language sources.

Ragnar Amason suggested to Phil Neher a small, mid-Atlantic conference on recent developments in fishery management. In the event, more than twenty papers were scheduled and over one hundred and fifty conferees were registered. Logistical complications were sorted through for a summer 1988 conference in Iceland. The really innovative management programs were in the South Pacific; Aus tralia and New Zealand had introduced Individual Transferable Quotas (ITQs); and Iceland, Norway and Canada were also experimenting with quotas. It seemed to the program committee (Rognvaldur Hannesson and Geoffrey Waugh were soon on board) that these quotas had more or less characteristics of property rights. Property rights were also taking other forms in other places (time and area licenses, restrictive licensing of vessels and gear, traditional use rights). The idea of rights based fishing became the theme of the conference.

The 1982 United Nations Convention on the Law of the Sea and the Agreement relating to the implementation of Part XI of the Convention constitute essential instruments of the law of the sea governing a new maritime order for the international community. With its entry into force on November 16, 1994, the 1982 United Nations Convention on the Law of the Sea has virtually become the Magna Carta of the Oceans, or the Constitution for the Oceans. Testifying to its success is the number of Parties adhering to it, now totaling 132 States, including one international organization, the European Community. The world is entering the era of a New Maritime Order based on near-universal adherence to the United Nations Convention on the Law of the Sea. In the wake of the Convention's entry into force and its ratification by many States in Northeast Asia, a new maritime order is emerging in the region. The littoral States have enacted and promulgated new national legislation to incorporate the provisions of the UN Convention into their domestic legal order. The three littoral States China, Japan and South Korea concluded or initialed bilateral fisheries agreements based on the new concept of extended jurisdiction set forth by the UN Convention. The UN Convention will, however, present even more challenges than opportunities for the littoral States of Northeast Asia in their quest for a new maritime order. The maritime security situation in the region has been and will continue to be extremely volatile due to conflicting claims, disputed boundaries, unregulated pollution of the marine environment and widespread illegal activities at sea. The author has set the both pragmatic and ambitious aim of outlining the emerging maritime order in Northeast Asia. As a practitioner of the law of the sea who has participated in bilateral and multilateral negotiations on maritime affairs, the author sheds light on the new maritime order in the making at the international and regional levels. The author also delineates the main issues and disputes hindering the establishment of a new maritime order in the region and present policy options that could contribute to erecting a solid maritime order in the region by peaceful and cooperative means. Finally, the author presents a compilation of relevant legal texts, most of which were produced after the entry into force of the UN Convention, in the hope that this collection will prove useful for desk officers in charge of ocean affairs in promoting peaceful and constructive solutions for maritime issues in Northeast Asia. This work serves as a realistic analysis of the current law and State practice, as well as of the progressive development of the law of the sea and its codification in the wake of the entry into force of the 1982 UN Convention.

Book excerpt: The state of the Northeast Atlantic fisheries in recent years has highlighted - plementation as the Achilles heel of modern fisheries management: discards and unreported or misreported landings are in many cases recognised to effectively subvert sound conservation goals. Social science literature on fisheries mana- ment has tended to regard the implementation of resource conservation policies mainly as a question of effective enforcement. This literature regards surveillance and penalty as the key mechanism through which fishermen keep to catch restr- tions and loyally report their catches. This book emerged because several years of research on fishermen’s compliance had made us uneasy about this rather narrow approach to the problem of implementation. This uneasiness motivated us to widen the approach to the question of implementing conservation policies in the fisheries. Taking Norway as an example, its fishing fleet consists of some 7,000 vessels spread along a coastline of more than 20,000 km, populated by less than 5 million people. The idea of ensuring desirable behaviour through surveillance and - forcement alone is almost absurd in such a context, as the task is impossible by any reasonable means. The Norwegian implementation system has thus had to rely heavily on the incentives provided by the rules and legitimacy created through a century of state/industry collaboration. Different coastal states face very different conditions in terms of solving typical implementation problems such as discards and misreporting.
