Book excerpt: In November 2008, the Regional Economic Studies Programme of the Institute of Southeast Asian Studies (ISEAS) and the Singapore office of the International Development Research Centre (IDRC) of Canada organised a forum on "Regional Economic Integration - ASEAN and Canadian Perspectives". The forum concluded that fundamentally the ASEAN Free Trade Area (AFTA) and the North American Free Trade Agreement (NAFTA) were two different kinds of agreements. First, while NAFTA focused entirely on trade and investments, the scope of AFTA was much broader, going beyond issues of trade and investments alone. Secondly, NAFTA was a lightly institutionalized regional trade agreement. There was no formal policy of institutional or policy development, and it lacked legislative instruments. Although ASEAN had a secretariat, its regional institutions remained weak in comparison to those of the European Union. Thirdly, the dispute-settlement mechanism in ASEAN was different from that of NAFTA. The ASEAN provisions were scattered over a number of documents and covered both economic (trade and investment) issues and other disputes (e.g., political or territorial), while NAFTA provisions were contained in a single document and could be applied only to matters related to trade and investments. Finally, although many studies presented trade liberalisation as a win-win proposition, the distribution of costs and benefits was mostly uneven. In the case of Canada, short-run gains in efficiency from expanded trade could be identified, but it was harder to determine longer-term dynamic gains. On the other hand, in the case of ASEAN, it was still grappling with the issue of the development divide, especially since the admission of Cambodia, Laos, Myanmar and Vietnam into the group.

However, the more recent narratives postulate that investment treaties and investor–state arbitration can lead to better governance not just for foreign investors but also for host state communities. Investment treaty law can arguably foster good governance by holding host governments liable for a failure to ensure transparency, stability, predictability and consistency in their dealings with foreign investors. The recent proliferation of such narratives in investment treaty practice, arbitral awards and academic literature raises questions as to their juridical, conceptual and empirical underpinnings. What has propelled good governance from a set of normative ideals to enforceable treaty standards? Does international investment law possess the necessary characteristics to inspire changes at the national level? How do host states respond to investment treaty law? The overarching objective of this monograph is to unpack existing assumptions concerning the effects of international investment law on host states. Instead, what we might call 'cooperative' sovereignty – which focuses on communication and interaction – is more responsive to the realities of interdependent economies in the twenty-first century. Nowhere is this more salient than in the area of dispute resolution, especially as labour, intellectual property, and the environment can no longer be evaded in trade negotiations. This ground-breaking book suggests that it is this shift in perspective that has given rise to the proliferation of Regional Trade Agreements (RTAs) and the inevitable overlaps and tensions between their provisions and those of the World Trade Organization (WTO). The author examines this phenomenon in great detail, and offers viable recommendations to restore coherence in the global trading system without upsetting the rights and obligations of WTO Member States. Because the WTO and RTAs must be viewed as layers of one system and must therefore have a relationship that extends to dispute settlement, such principles of subsidiarity as autonomy, mutual assistance, and flexibility are key to a successful institutional relationship between the WTO and RTAs. From this theoretical springboard, the author proceeds to analyse the following issues and more: – the relationship between WTO and RTAs based on Article XXIV of GATT; - the extent to which WTO panels can apply RTA law; - the extent to which the WTO panels can hear RTA claims; - opportunity for RTA Members to secure preliminary rulings and advisory opinions from the WTO; - recognition by WTO panels of the results of litigation or arbitration that took place at the RTA level; - opportunity for RTA Members to appeal RTA dispute settlement decisions to the WTO; and - clarification of WTO rules designed to enable RTA activities (or intervene if necessary). Major cases decided at the WTO and RTA levels that manifest conflict between RTAs and the WTO are fully analysed. Confronting directly the stagnation in negotiating and concluding new trade agreements at the multilateral level and the fragmentation of the international trade law system, this important book shows clearly how the institutional relationship between the WTO and RTAs can be restructured with a view to establishing mutual recognition of the judgments of both. In a nutshell, the book calls for reconfiguration of WTO Dispute Settlement Body to perform functions of World Trade Court that is capable of hearing disputes arising between WTO Members, RTA Members and Non-WTO Members.
