Download or read book Antitrust between EU Law and national law/Antitrust fra diritto nazionalee diritto dell'unione europea written by Enrico Adriano Raffaelli and published by Bruylant. This book was released on 2019-09-09 with total page 385 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work contains the papers of the thirteenth Conference on “Antitrust between EU Law and national law”, held in Treviso on May 24 and 25, 2018 under the patronage of the European Lawyers Union – Union des Avocats Européens (UAE), the Associazione Italiana per la Tutela della Concorrenza - the Italian section of the Ligue Internationale du Droit de la Concurrence (LIDC)-, the Associazione Italiana Giuristi di Impresa (AIGI), the European Company Lawyers Association (ECLA), and the Associazione Antitrust Italiana (AAI). Some of the papers have been extensively reviewed and updated by the authors prior to publication. The contributions contained in this volume are the result of an in-depth analysis and study of the most salient issues arising from the application of antitrust rules, carried out by experienced and high-ranking professionals, in-house lawyers, academics and EU/national and international institutional representatives who attended the Conference. They deal with extremely topical issues, lying at the heart of current antitrust debate. Some of the most contemporary topics include those related to private antitrust enforcement after the implementation of Directive 2014/104/EU, and to the interplay between antitrust and intellectual property rights. Ample consideration is also given to recent developments in the field of new technologies and the related antitrust issues, as well as to the relations between consumer protection and antitrust.

Book Synopsis Competition and Regulation in Shipping and Shipping Related Industries by : Antonis Antapassis
Download or read book Competition and Regulation in Shipping and Shipping Related Industries written by Antonis Antapassis and published by BRILL. This book was released on 2009-05-06 with total page 416 pages. Available in PDF, EPUB and Kindle. Book excerpt: Maritime competition as an economic phenomenon is currently influenced by a number of factors both at EU and international level. From a legislative point of view, the recent repeal of EC Reg. 4056/1986 affects the treatment of horizontal agreements not only in the liner but also in the bulk sector, which was excluded until recently from the scope of EC secondary competition rules. However, competition distortions are not only a question of private arrangements. They emanate also from measures and practices incompatible with the freedom to provide services, Member states’ protectionism and international mandatory regulation. This volume comparatively and comprehensively examines all these issues, by bringing together contributions from distinguished academics. Particular focus is given on private shipping cartels, the liberalization of cabotage and port services, indirect competition-distorting factors and the latest developments on international regulation of carriage of goods by sea.
Book Synopsis The Just Culture Principles in Aviation Law by : Francesca Pellegrino
Download or read book The Just Culture Principles in Aviation Law written by Francesca Pellegrino and published by Springer Nature. This book was released on 2019-09-09 with total page 161 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book reviews and critically analyzes the current legal framework with regard to a more just culture for the aviation sector. This new culture is intended to protect front-line operators, in particular controllers and pilots, from legal action (except in the case of willful misconduct or gross negligence) by creating suitable laws, regulations and standards. In this regard, it is essential to have an environment in which all incidents are reported, moving away from fears of criminalization. The approach taken until now has been to seek out human errors and identify the individuals responsible. This punitive approach does not solve the problem because frequently the system itself is (also) at fault. Introducing the framework of a just culture could ensure balanced accountability for both individuals and complex organizations responsible for improving safety. Both aviation safety and justice administration would benefit from this carefully established equilibrium.

Book Synopsis Regulatory Reforms in Italy by : Dieter Kerwer
Download or read book Regulatory Reforms in Italy written by Dieter Kerwer and published by Routledge. This book was released on 2018-01-18 with total page 347 pages. Available in PDF, EPUB and Kindle. Book excerpt: This title was first published in 2001. The question this thesis attempts to answer is summarized as follows: what accounts for the amazing stability of Italian transport policy in the face of European challenges, given the fact that - as most national and European policy-makers readily believe - it is not capable of addressing the problem of the sector? This study analyzes the transport policy in Italy from the 1990s into the 21st century. It looks at how the two sub-sectors of surface transport, road haulage and raliways, have been managed by the public and private actors involved. In both sectors the policy appears to have failed, either by not offering a remedy to problems or by aggravating them further. The author believes that studying transport policy in Italy will shed light on the wider question of how national policy-making patterns are influenced by developments in the international environment; in this case looking closely at the influence of the European Union.

Download or read book Sales written by E. H. Hondius and published by sellier. european law publ.. This book was released on 2008 with total page 526 pages. Available in PDF, EPUB and Kindle. Book excerpt: The sales contact has served as the paradigm for contracts in general. Moreover, it is also probably the most common contract, and certainly the most common consumer contract that there is. Furthermore, there are many mixed transactions that contain a certain element of sale, such as distribution contracts or all sorts or manufacturing contracts. This book presents the rules regarding sales contracts under European law. The principles examined here start from the idea of a uniform regime for all kind of sales transactions. Moreover, these principles aim to meet the needs of international and national commerce alike and attempt to create a truly uniform sales law, bridging the differentiation into different settings, different parties to the contract, and different object of sales. However, when deemed necessary, certain provisions are declared mandatory in consumer sales in order to protect the weaker party in the transaction involved. To that end, a balance is struck between the two major international instruments in this area, the CISG (Contracts for the International Sale of Goods) and the Consumer Sales Directive. Moreover, during the drafting process, comparative material from over 20 different EU Member States has been taken into account. The work is not only a presentation of a future model for European rules to come, but also provides a fairly detailed indication of the present legal situation in the Member States.
