The present work systematically examines these two important prerequisites for tortious liability under the combined heading of ‘misconduct’. Unlike current textbooks, national casebooks and monographs, it builds on the experiences gathered in the national legal systems over the past decades and thereby fills a major gap which still exists today. It thus does what the previous volumes in the ‘Digest of European Tort Law’ series did for other key elements of tort law, namely natural causation and damage. Once again, the publication contains a selection of the most important cases from 28 states across Europe as well as cases handed down by European Union courts; it also highlights cases from earlier periods of legal history. For each case, the facts and the relevant court decision are presented and these are then accompanied by an analytical commentary. In addition, the editors provide comparative analyses of the cases reported and a special report is dedicated to how key decisions would be resolved under model European rules on tort law. The editors believe that the material gathered here may provide guidance for an organic convergence of the national legal systems in Europe. It constitutes the basis of an acquis commun that is infinitely richer (though also much more complex) than the rather bland and abstract concepts contained in national codifications, European legislation and modern model rules.

Courts are often unable to determine whether a defendant’s tortious conduct was a factual cause of a plaintiff’s harm. Yet, sometimes courts can determine the probability that the defendant caused the plaintiff’s harm, although often there is considerable variance in the probability estimate based on the available evidence. The conventional way to cope with this uncertainty has been to apply the evidentiary rule of ‘standard of proof’. The application of this ‘all or nothing’ rule can lead to unfairness by absolving defendants who acted tortiously and may also create undesirable incentives that result in greater wrongful conduct and injustice to victims. Some courts have decided that this ‘no-liability’ outcome is undesirable. They have adopted rules of proportional liability that compensate plaintiffs according to the probability that their harm was caused by the defendant’s tortious conduct. In 2005 the Principles of European Tort Law (PETL) made a breakthrough in this regard by embracing rules of proportional liability. This project, building on PETL, endeavours to make further inquiries into the desirable scope of proportional liability and to offer a more detailed view of its meaning, implications, and ramifications.

Book excerpt: Fifty years after the famous essay “The Problem of Social Cost” (1960) by the Nobel laureate Ronald Coase, Law and Economics seems to have become the lingua franca of American jurisprudence, and although its influence on European jurisprudence is only moderate by comparison, it has also gained popularity in Europe. A highly influential publication of a different nature was the Brundtland Report (1987), which extended the concept of sustainability from forestry to the whole of the economy and society. According to this report, development is sustainable when it “meets the needs of the present without compromising the ability of future generations to meet their own needs”. A key requirement of sustainable development is justice to future generations. It is still a matter of fact that the law as well as the theories of justice are generally restricted to the resolution of conflicts between contemporaries and between people living in the same country. This in turn raises a number of questions: what is the philosophical justification for intergenerational justice? What bearing does sustainability have on the efficiency principle? How do we put a policy of sustainability into practice, and what is the role of the law in doing so? The present volume is devoted to these questions. This project, "Loss of Housekeeping Capacity", was undertaken at the request of the Swiss Insurance Association.

Im letzteren Fall ist vor allem die Deliktsfähigkeit des Minderjährigen zu klären. Oft führen Verkehrsunfälle zu schweren Verletzungen mit Dauerfolgen. Es kann zu einem Erwerbsschaden und einem Mehrbedarf durch Betreuung und Pflege kommen. Verunglücken die Eltern tödlich, geht es auf Seiten der Kinder vor allem um den Ersatz von Unterhaltsansprüchen. Der mit solchen Verkehrsunfällen betraute Rechtsanwalt hat darauf zu achten, dass er eine wirksame anwaltliche Vollmacht erhält und den Sachverhalt ausreichend aufklärt. Auch Kinder können für die Aufklärung wertvolle Zeugen sein. Bei der Auszahlung des Schadensersatzes kann der Rechtsanwalt gehalten sein, dafür Sorge zu tragen, dass das Geld mündelsicher angelegt wird. Der Band richtet sich an Richter, Fachanwälte und andere Praktiker aus dem Verkehrs- und Versicherungsrecht sowie Wissenschaftler.

Private law reforms were completed successfully in all three Baltic states in 2002. Each state used its own approach to master the task of transforming private law. In this work, the authors discuss the law reforms in a historical, comparative and European context. They analyze the legislative task in a historical and comparative perspective. Reports on each country give a comparative insight into the current Baltic civil codes. In conclusion, the authors deal with legislative instruments, such as the use of legal transplants, and analyze the process of the Europeanization of the Baltic civil codes in the course of EU accession. German description: Erneuerung und Europaisierung des Privatrechts waren nach der 'Wende' zwei Hauptaufgaben der baltischen Privatrechtsgesetzgeber. Unterschiedliche Ausgangspositionen in den einzelnen baltischen Staaten haben dazu gefuhrt, dass die baltischen Staaten das Reformwerk nicht im Wege der Kooperation (insbesondere im Rahmen des Baltischen Rates) verfolgt, sondern trotz ahnlich gelagerter Sachprobleme je fur sich in Angriff genommen haben. Alle drei baltischen Staaten haben ihre Reformen im Jahre 2002 (jedenfalls vorlaufig) erfolgreich abgeschlossen. Im vorliegenden Tagungsband wird die Zivilrechtsreform in den baltischen Staaten aus historischer, vergleichender und europarechtlicher Perspektive untersucht. Historisch wird zunachst der Frage nachgegangen, ob und inwieweit von einer (einheitlichen) baltischen Rechtstradition gesprochen werden kann. Es folgen Beitrage zu den (historischen) Anforderungen an die Zivilrechtsreform und zu den von den baltischen Staaten gewahlten Wegen der Erneuerung des Privatrechts. Drei Landerberichte werfen einen vergleichenden Blick auf die heutigen Zivilgesetzbucher der baltischen Staaten. Am Schluss werden Querschnittsfragen behandelt. Hierher gehoren Ausfuhrungen zu Rechtsrezeption und Rechtsmischung als Instrumente der Transformationsgesetzgebung und zur Europaisierung der baltischen Zivilrechte im Zuge des EU-Beitritts dieser Staaten.
