Im Verlauf dieser Arbeit wird der Frage nach dem Verhältnis zwischen dem geschriebenem Recht und der Rechtswirklichkeit nachgegangen. Soziologen beobachten das Recht von einem externen Standpunkt aus und die Theorien der Soziologen bauen auf empirische Forschungen auf. Soziologen wie Eugen Ehrlich bearbeiten die Ursache der Ungleichheit unter den Menschen und deren Eventualitäten ihrer Bekämpfung durch das Recht. Juristen geht es um die Frage, wie Richter urteilen und entscheiden müssen und welches Gesetz dabei angewendet werden soll. Dabei geht es für Rechtssoziologen darum, warum entscheiden die Richter auf die Art und Weise, worauf bauen ihre Entscheidungen auf und was sind Ihre wirklichen Beweggründe. Im Allgemeinen fragen Juristen aus der Teilnehmerperspektive und Soziologen aus der Beobachterperspektive, deswegen liegt für den Rechtssoziologen Eugen Ehrlich der Schwerpunkt der Rechtsentwicklung weder in der Gesetzgebung, noch in der Jurisprudenz oder in der Rechtsprechung, sondern in der Gesellschaft selbst. Für Ehrlich hat die empirische Rechtssoziologie eine hohe Bedeutung für das Recht, denn die Schaffung von Normen ist eine Grundlage für die Rechtsetzung und die Änderung der demografischen und sozialen Realitäten eine Voraussetzung der Rechtsanwendung. Die vorliegende Arbeit befasst sich im zweiten Kapitel mit die Lebens- und Wirkungskreise von Eugen Ehrlich. Danach folgt die Definition des praktischen Rechtsbegriffs durch die Beispiele vom Recht als Regel des Handelns und als staatliche Zwangsordnung erklärt. Daraufhin wird Ehrlichs Rechtstheorie mit seiner Hauptthese des lebenden Rechts und den drei dazu gehörigen Annahmen erläutert. Schlussendlich wird das geschriebene Recht mit der Rechtswirklichkeit der heutigen Zeit verglichen.
