Book excerpt: Spanish Abstract: En México los Organismos Operadores de Agua Potable, Alcantarillado y Saneamiento (OOAPAS) son las entidades encargadas de prestar los servicios municipales de agua potable, alcantarillado y saneamiento a la población, sin embargo, no es tarea fácil dado el constante crecimiento demográfico y la demanda de los servicios, por ello los OOAPAS se ven minimizados en infraestructura y capacidad operativa, y en algunos casos los ingresos que obtienen por la prestación del servicio sólo alcanza para mantener la infraestructura existente de agua potable, alcantarillado y saneamiento, más no para ampliación de la misma o ejecución de acciones preventivas y de concientización ciudadana de no contaminar los cuerpos de agua. En México la eficiencia global de los organismos operadores es de las más bajas a nivel internacional; al respecto se conoce que, del volumen total del agua entregada en bloque a los OOAPAS, sólo se factura en promedio el 53%, y únicamente se cobra el 73% (39% del volumen total). Como caso particular se presente el trabajo realizado por el Instituto Mexicano de Tecnología del Agua (IMTA) y financiado por la Fundación Gonzalo Río Arronte I. A. P. (FGRA) en el Marco del Programa para la Recuperación Ambiental de la Cuenca del Lago de Pátzcuaro (etapa IV 2014-2018), con el objetivo de elaborar el diagnóstico y plan de acción para modernizar el área comercial de 4 OOAPAS ribereños del Lago de Pátzcuaro en Michoacán, a fin de fortalecer los ingresos propios de los organismos operadores a través de incrementar la recaudación de los derechos por consumo de agua, mediante la actualización del padrón de contribuyentes y mejoramiento de la eficiencia del área comercial. Como resultado se presenta un documento con la descripción detallada de acciones propuestas que llevará a cabo cada organismo operador en el corto y mediano plazo a fin de fortalecer la gestión administrativa y el pago de los derechos por el suministro de los servicios. Asimismo, se presenta la estimación de costos de adquisición de cada uno de los bienes y/o servicios que serán necesarios adquirir.

El análisis se concentra en las características institucionales que adquiere la descentralización de los servicios, a la luz del proceso de reforma del Estado, vinculada a dos ideas fuerzas que han modulado la reforma sectorial a nivel global: (i) la Gestión Integrada de los Recursos Hídricos (GIRH) como enfoque dominante orientado a logra que la gestión del agua sea económicamente eficiente, socialmente equitativa y ambientalmente sostenible; y recientemente (ii) la gobernanza del agua (water governance), que al comienzo del presente siglo emerge como tema prioritario en la agenda de discusión mundial para superar la «crisis global del agua» En el centro del análisis se encuentra una cuestión normativa que, desde la reforma municipal de 1983, se cierne sobre el espacio institucional del federalismo mexicano y transita diferentes áreas de política, pero ha quedado sin respuesta: ¿la debilidad endémica que exhiben los gobiernos municipales para cumplir a cabalidad con sus obligaciones constitucionales es cuestión de su diseño institucional o solo de fortalecimiento de sus capacidades? La tesis retoma el análisis institucional desarrollado por Elinor Ostrom conocido como situación de acción y es fortalecido con el enfoque de gobernanza interactiva, propuesto por Kooiman, que resulta sugerente por su paralelismo con el modelo propuesto por E. Ostrom y por su reciente aplicación para valorar la gobernanza de los sistemas de recursos naturales, en particular de la pesquería y la acuacultura.
