Book excerpt: Kenya's new constitution marks a critical juncture in the nation's history. It is widely perceived, by Kenyans from all walks of life, as a new beginning. Indeed, many feel that post- independence Kenya has been characterized by centralization of political and economic power in the hands of a few, resulting in an uneven and unfair distribution of resources and corresponding access to social services; the opposite of an inclusive state. Born of the political opportunity created by the 2008 post-election violence, the constitution finally adopted, after almost a decade of unsuccessful reform attempts, presages far-reaching changes. Its vision encompasses a dramatic transformation of the Kenyan state through new accountable and transparent institutions, inclusive approaches to government and a firm focus on equitable service delivery for all Kenyans through the newly established county governments. Devolution is at the heart of the new constitution and a key vehicle for addressing spatial inequities. A more decentralized government makes eminent sense, given Kenya's diversity and experience with political use of central power. Decentralization has been increasingly seen and adopted worldwide as a guarantee against discretionary use of power by central elites as well as a way to enhance the efficiency of social service provision, by allowing for a closer match between public policies and the desires and needs of local constituencies. Kenya's constitution entrenches devolved government by guaranteeing a minimum unconditional transfer to counties under the new dispensation. The devolution train has already left the station: the challenge is to make sure it arrives at destination, safely and on time. The politics of devolution explain the high intensity of hopes and expectations that have been pinned to it. It also means there are high risks if they are disappointed. There are great opportunities and enormous challenges waiting for Kenya, in a critical election year, which will determine the fate of the country, politically and economically for years to come. This report takes a snapshot look at the critical issues facing Kenya's policy makers today. It does not argue for or against devolution (a decision that belongs solely to Kenyans), but presents suggestions and recommendations on how best to navigate the tough choices ahead. It's main focus in on helping Kenya manage a delicate transition.

The new Constitution was the institutional response to longstanding grievances over the centralization of state powers and public sector resources, and regional disparities in service delivery and development outcomes. This radical restructuring of the Kenyan state has three main objectives: decentralizing political power, public sector functions, and public finances; ensuring a more equitable spatial distribution of resources between regions; and promoting more accountable, participatory, and responsive government at all levels. The first elections under the new Constitution were held in 2013. Alongside the national government, 47 new county governments were established. Each county government is made up of a County Executive, headed by an elected Governor and works under the oversight of an elected County Assembly. Seven years after the "devolution train" left the station, this report takes stock of how devolution has affected the delivery of devolved basic services to Kenyan citizens. Whereas devolution was driven by political reform, the ensuing institutions and systems were expected to deliver greater socioeconomic equity through devolved service delivery. The Making Devolution Work for Service Delivery (MDWSD) study is the first major assessment of Kenya’s devolution reform. The study was a jointly coordinated effort by the Government of Kenya and the World Bank. The study provides key messages with respect to what is working, what is not working, and what could work better to enhance service delivery based on the currently available data. It provides an independent assessment of service delivery performance in five sectors, namely health, education, agriculture, urban, and water services and includes an in-depth review of the main pillars of devolved service delivery, namely public financial management, intergovernmental finance, human resource management, politics and accountability.

Marshall, and talks only about the British state, often referring only to England. But social citizenship rights require taxation, spending, effective public services and politics committed to them. They can only be as strong as politics makes them. That means that the distinctive territorial politics of the UK are reshaping citizenship rights as they reshape policies, obligations and finance across the UK. This timely book explores how changing territorial politics are impacting on social citizenship rights across the UK. The contributors contend that whilst territorial politics have always been major influences in the meaning and scope of social citizenship rights, devolved politics are now increasingly producing different social citizenship rights in different parts of the UK. Moreover, they are doing it in ways that few scholars or policymakers expect or can trace. Book excerpt: Fiscal decentralization is becoming a pressing issue in a number of countries in sub-Saharan Africa, reflecting demands for a greater local voice in spending decisions and efforts to strengthen social cohesion. Against this backdrop, this paper seeks to distill the lessons for an effective fiscal decentralization reform, focusing on the macroeconomic aspects. The main findings for sub-Saharan African countries that have decentralized, based on an empirical analysis and four case studies (Kenya, Nigeria, South Africa, Uganda), are as follows: • Determinants and effectiveness: Empirical results suggest that (1) the major driving forces behind fiscal decentralization in sub-Saharan Africa include efforts to defuse ethnic conflicts, the initial level of income, and the urban-ization rate, whereas strength of democracy is not an important determi-nant for decentralization; and (2) decentralization in sub-Saharan Africa is associated with higher growth in the presence of stronger institutions. • Spending assignments: The allocation of spending across levels of gov-ernment in the four case studies is broadly consistent with best practice. However, in Uganda, unlike in the other three case studies, subnational governments have little flexibility to make spending decisions as a result of a deconcentrated rather than a devolved system of government. • Own revenue: The assignment of taxing powers is broadly in line with best practice in the four case studies, with the bulk of subnational revenue coming from property taxes and from fees for local services. However, own revenues are a very small fraction of subnational spending, reflecting weak cadaster systems and a high level of informality in the economy.

Book excerpt: In this paper we explore the implications of Nepal’s new federal Constitution—passed in September 2015—for governance of the agricultural sector. Agriculture is the backbone of the Nepali economy, providing a livelihood for approximately two-thirds of the population, contributing one-third of the country’s GDP, and constituting more than half of the country’s exports. In transitioning from a unitary to a federal republic—with greater authority and autonomy granted to subnational units of government—it is of paramount importance to ensure that the agricultural sector is guided by coordinated planning, retains sufficient human capacity, and receives adequate fiscal resources. These considerations are particularly important given that the governance of Nepal’s agricultural sector already suffers from poor coordination, low human resources capacity, and inadequate financial resources. Addressing these issues may become more difficult under a federal structure. This paper begins by laying out the main challenges for agricultural governance in Nepal under the current structure. To do so, it relies on an original survey of 100 district agricultural and livestock officers in charge of local agricultural service delivery in Nepal as well as perspectives collected through more than two dozen semi-structured interviews with officials from the Ministry of Agricultural Development, the Ministry of Livestock Development, civil society, the private sector, and donors. Because Nepal is embarking on a pathway to more decentralized governance, which has been well-trodden by a number of other countries, the paper proceeds by examining five case studies, drawing lessons from India, Indonesia, Kenya, Malaysia, and South Africa. Based on these analyses, the paper offers policy recommendations on how the sector can be restructured to meet the constitutional provisions, while simultaneously ensuring that the government can deliver on its long-term objectives to develop the agricultural sector.
