Planners involved in a decentralizing reform must identify which components of the system are more appropriately managed at the central level and which at the local level. This book is intended to inform education policymakers, planners, and practitioners about international experience in the legal aspects of decentralizing basic education. It also provides a basic understanding of how laws and regulations can be used for education reform. For purposes of the discussion, decentralization is used to describe efforts to transfer decision making power in basic education from the administrative center of a country to authorities closer to users. The term is also used in a more technical sense to describe one of the many forms this type of reform can take, and in this sense it is contrasted with deconcentration and devolution as educational reforms. The first section examines the general legal aspects of decentralization, and the second looks more closely at decentralization laws and regulations. The third section is, in effect, a checklist of items that should be included in decentralization laws, and the fourth section provides a road map to help the planner prepare and implement the laws required for reform. Although an effort has been made to keep the discussion general enough for use in many countries, the analysis is based on the legal systems of the Western world or those that they inspired. This study incorporates data from comparable surveys across five African countries--Ghana, Malawi, Mali, Senegal, and Tanzania--to analyze how small and micro enterprises have been positively and negatively affected by policy liberalization schemes. Some grow rapidly by adapting their products, while others stagnate because of import competition and increased self- employment. Comparisons were made between small firms, with 6 to 49 workers, and microenterprises, with fewer than 6. The study suggests a two-pronged strategy: (1) to facilitate widespread participation in microenterprises, broad measures are needed to lower the costs of entry, generate demand for their goods and services, raise the educational level and incomes of the poor, and encourage informal financial institutions; (2) to stimulate growth of potentially dynamic enterprises, well-targeted measures may be appropriate to lower the costs of entry, increase access to credit, and provide demand-driven business services. This book is a collection of eight papers written by nine authors who were intimately involved in the complex decentralization reform process in Sierra Leone from 2003 07. During this period, Sierra Leone s government established elected district and urban councils across the country, transferred certain responsibilities for primary services and local investment and some financial resources to the new councils, and invested heavily in building the administrative infrastructure and capacity of the local councils. Compared to most other Sub-Saharan African countries that have embarked upon decentralization, Sierra Leone s progress in building local government capacity and restructuring the fiscal system is enviable. The authors conclude that improved security and public services are possible in a decentralizing country and Sierra Leone s progress would not have been possible without significant effort at fiscal decentralization and intensive investment in local government capacity building. The most critical ingredient for this promising but fragile reform process is the dynamic leadership team in charge of promoting the new institutional framework and their persistent effort to achieve quick improvement in the local government system and public services.
