En France, les condamnations pénales prononcées à l’encontre des Auteurs de violences sexuelles (AVS) peuvent être exécutées en milieu ouvert. Dans ce cadre, une injonction de soins est très souvent imposée par un Juge après expertise médicale Ayant pour objectif la diminution du risque de récidive, l’injonction de soins définit l’organisation des relations entre les autorités judiciaires et sanitaires, à travers l’action du médecin coordonnateur L’évaluation du risque de récidive, effectuée par ce dernier (essentiellement psychiatre), est une tâche difficile pour laquelle des outils restent à définir. Le concept de désistance, processus désignant la sortie de la délinquance, peut être intéressant à utiliser dans les suivis des AVS. Matériels et méthodes. Une revue de la littérature a permis d’identifier plus d’une vingtaine d’études internationales, rapportant le devenir de délinquants sur plusieurs dizaines d’années. Ainsi, nous avons pu recenser les principaux facteurs de sortie de délinquance. Résultats. Les facteurs de désistance peuvent être regroupés en facteurs statiques, non modifiables, et en facteurs dynamiques, susceptibles de changement et pouvant être suivis durant la prise en charge. Les facteurs dynamiques identifiés par notre revue de littérature sont l’engagement dans des activités altruistes, un emploi stable et légal, la stabilité des liens familiaux, la parentalité, le mariage/les relations amoureuses stables, la modification de l’entourage, l’internalisation du locus de contrôle, le contrôle de soi, l’espoir/1’optimisme, le sentiment d’avoir trouvé sa place au sein de la société, la motivation au changement et l’adhésion aux traitements. Les facteurs statiques ou non modifiables mis en évidence sont l’âge, les violences subies pendant l’enfance et le niveau de scolarisation. Discussion. Le repérage des facteurs de désistance pourrait permettre d’appréhender au mieux le risque de récidive des AVS. Une grille facilitant le recensement de ces facteurs est proposée à l’attention des médecins coordonnateurs, qui devra être validée ultérieurement.

Dans un premier temps, nous avons développé et élaboré les aspects théoriques du processus de la désistance, en s'appuyant à la fois sur une lecture de la législation française et des aménagements au sein du système pénal français depuis la loi du 17 juin 1998 qui créé l'injonction de soins, et en réalisant parallèlement une revue de la littérature scientifique sur le sujet de la désistance afin de mieux en comprendre les aspects cliniques et les limites rencontrée chez les auteurs de violence sexuelle. Nous avons réalisé une étude sur les facteurs et les limites de celle-ci, sur la population des 162 personnes placées sous main de justice, dans le cadre du suivi socio-judiciaire avec injonction de soins, au 16 avril 2017, en Drôme-Ardèche et en région Lyonnaise. Les résultats de cette étude comparative mettent en évidence une récidive légale accrue des individus suivis en injonction de soins en Drôme-Ardèche, corrélée à une fragilité globale du maillage Santé-Justice-Social par rapport à la région Lyonnaise. Ces résultats mettent en lumière une disparité des moyens dédiés à l'injonction de soins dont les caractéristiques en ce qui concerne les individus et l'infraction n'ont pas montré de différence significative. Ce travail a pour but d'interpeller les pouvoirs publics et d'attirer l'attention sur l'importance du maillage Santé-Justice-Social qui porte le processus de désistance des auteurs de violence sexuelle repérés par le système pénal et soumis à un suivi socio-judiciaire avec injonction de soins.

This resulted in the development of intervention programs designed to modify the characteristics of individuals and their environments associated with crime. The predictive nature of their legacy lies in their ability to provide reliable information about the likelihood of future reoffending. In this respect, dynamic risk factors are useful complements to static risk factors such as age, gender, and history of offending, and add incremental validity to recidivism prediction. Their treatment utility resides in the fact that practitioners increasingly rely on the identification of dynamic risk factors to direct correctional assessment and interventions. Thus, dynamic risk factors have a dual status. They are both useful predictors of reoffending and measures of risk status, and potential causes of reoffending, capable of serving an explanatory role as well as a predictive one. It is a simple and powerful conceptualization that has streamlined forensic and correctional research, program development, and the delivery of treatment. Despite its conceptual elegance we believe that the dual conceptualization of dynamic risk factors is problematic and these difficulties spill over into their role in assessment, assessment, treatment, and desistance contexts. In this publication, the nature and function of dynamic risk factors are investigated and their strengths and limitations identified.
