Au-delà du concept de custodia, c'est l'ensemble du système classique de responsabilité contractuelle qui est examiné à travers ses composantes principales, le dol, la faute, la force majeure. Cette étude s'adresse non seulement aux romanistes, mais également aux historiens de l'Antiquité et, d'une manière générale, à tous ceux qu'intéresse la genèse de notre droit positif. À l'heure où l'on assiste, dans plusieurs branches du droit positif contemporain, à une interrogation sur l'opportunité, pour imputer un dommage à un débiteur, de tenir compte du comportement qu'il a eu, une des formes qu'a prise cette interrogation dans le passé méritait d'être étudiée.
