Book excerpt: Este libro reflexiona en torno a las implicaciones de la actual configuración constitucional de los derechos y sus garantías, derivadas de la reforma de 2011, partiendo de una concepción amplia de los derechos humanos que incluye a los económicos, sociales y culturales y a toda una serie de derechos que se han venido reconociendo desde las últimas décadas del siglo xx hasta nuestros días, como los derechos de la mujer y los derechos colectivos de los pueblos indígenas. Los trabajos aquí reunidos se ocupan principalmente de un cierto tipo de implicaciones, las de tipo teórico-conceptual, de orden metodológico o interpretativo y las de tipo histórico, ya que estas son determinantes para la eficacia de esta reforma, que nos obliga a repensar y reconceptualizar nuestra idea de los derechos constitucionales y su protección. El autor sostiene que las implicaciones de la reforma en materia de derechos humanos tienen que ir más lejos, lo que implica hacer una revisión doctrinal profunda. Entre estas, se encuentran las de orden conceptual, que nos obligan a analizar los conceptos de “derechos humanos”, “derechos constitucionales”, “interés legítimo”, entre otros, y atender a los cambios producidos al haberse abandonado otros conceptos. La tesis que se defiende sostiene que la centralidad que tiene el concepto de “derechos humanos” nos debe llevar a un cambio en nuestra doctrina constitucional; los constitucionalistas tienen ahora la obligación de adecuar sus teorías dogmáticas a este cambio conceptual. El análisis aquí presentado no solo es el de un constitucionalista, sino el de un filósofo o teórico del derecho que trata de advertir sobre algunos de los retos que ahora tienen enfrente los constitucionalistas. Se intenta orientar cómo entender estos desafíos y ensayar, a partir de la experiencia del autor, en temas de derechos humanos que permitan visualizar algunos temas, problemas y sus soluciones.

Public power can only be legitimately exercised if it is based on and complies with the law. The Constitution and its fundamental values – human dignity, freedom and equality – are the ultimate sources of orientation for the rule of law. Domestic rule of law is complemented by its external dimension, the duty to respect international law and, for EU member states, supranational law. For the World Jurist Association, the realization of the Rule of Law has been the central concern since its founding more than 60 years ago. Its biennial world congresses, which bring together leading figures from politics, the judiciary and academia under the presidency of Javier Cremades, focus on the universal importance of the rule of law, which experts from numerous countries discuss on the basis of current problem areas. At the 2021 World Law Congress in Barranquilla, Colombia, one central topic was the tension between combating pandemics and the rule of law. The contributions gathered here examine how this challenge was met in political-legal practice, and the role of constitutional jurisdiction in the process. They analyze and evaluate the legal situation in numerous countries in Europe and Latin America.
