Book excerpt: Este libro se adentra en el estudio de distintas cuestiones que inciden en el efectivo goce de los derechos de los pueblos indígenas y tribales en la región latinoamericana. En primer término se presentan al lector algunas reflexiones sobre la evolución del reconocimiento de tales derechos, partiendo de un claro análisis en torno a los criterios hasta ahora desarrollados por la Comisión y la Corte Interamericana de Derechos Humanos. Enseguida, los autores pretenden describir el fundamento jurídico y proponer un fundamento ético para el ejercicio diferenciado de derechos por parte de dichos pueblos y su colisión con el interés de los Estados, analizando además la evolución del derecho constitucional indigenista en América Latina, que ha permitido el surgimiento de marcos constitucionales ajustados a sociedades pluriculturales que –en ciertos casos– permiten la consagración de la consulta previa. Asimismo se analiza el tema de la justiciabilidad de los derechos económicos, sociales, culturales y ambientales de los pueblos indígenas y tribales vinculados con la propiedad territorial en la jurisprudencia de la Corte Interamericana; para concluir con contrastantes reflexiones acerca de la implementación de proyectos de extracción, inversión o desarrollo que impactan en sus vidas. La obra que ponemos a su disposición constituye una importante fuente de análisis para quienes se interesan en las problemáticas antes planteadas, cuyo estudio es fundamental en sociedades pluriculturales como las latinoamericanas.
