De inicio se muestra un capítulo de "introducción", con lo que se busca explicar la importancia del contenido, se detalla una "breve historia romana" alusiva a los "orígenes de la península italiana", los "pueblos que conformaron la península itálica", sobre todo los pueblos que se establecieron en la región del Lazio, (centro-sur de Italia), los etruscos, (norte-centro de Italia) y los colonizadores griegos que se establecieron en el sur de Italia, todos ellos contribuyeron al crecimiento de Roma a partir de su fundación en el siglo VIII a.C. La obra de "Rómulo y Remo", "La Monarquía", "La República, "El Imperio" (sus emperadores y su ocaso); cómo surge el "Derecho Romano", y "el uso del latín en el derecho". Con la explicación breve en cada una de las locuciones y vocablos, (de las de mayor importancia), se busca explicar el sentido de las mismas, es decir, lo que pensaron y quisieron decirnos los antiguos jurisconsultos romanos. De manera general, se muestra brevemente la historia romana, la conformación del Derecho y las locuciones con una breve explicación.

Además, articula las luchas prácticas con las investigaciones sobre el gobierno colectivo de los recursos naturales o de la información y designa formas democráticas nuevas que aspiran a tomar el relevo de la representación política y del monopolio de los partidos. Esta emergencia de lo común en la acción reclama un trabajo de clarificación en el pensamiento. El sentido actual de lo común se distingue de los numerosos usos que se ha dado a esta noción, ya sean filosóficos, jurídicos o teológicos: bien supremo de la ciudad, universalidad de esencia, propiedad inherente a ciertas cosas, incluso alguna vez el fin perseguido por la creación divina. Pero hay otro hilo que vincula lo común, no a la esencia de los hombres o a la naturaleza de las cosas, sino a la actividad de los hombres mismos: sólo una práctica de puesta en conjunto puede decidir qué es “común”, reservar ciertas cosas al uso común, producir determinadas reglas capaces de obligar a los hombres. En este sentido, lo común reclama una nueva institución de la sociedad por ella misma: una revolución.

But just how was this legal order imposed throughout the New World? Re-created here from six hundred civil and criminal cases are the procedural and ethical workings of the law in two of Spain's remote colonies--New Mexico and Texas in the eighteenth century. Professor Cutter challenges the traditional view that the legal system was inherently corrupt and irrelevant to the mass of society, and that local judicial officials were uninformed and inept. Instead he found that even in peripheral areas the lowest-level officials--thealcaldeor town magistrate--had a greater impact on daily life and a keener understanding of the law than previously acknowledged by historians. These local officials exhibited flexibility and sensitivity to frontier conditions, and their rulings generally conformed to community expectations of justice.
