Book excerpt: En la tesis se analizan los diferentes esquemas jurídicos a través de los cuales se ha planteado el fenómeno de la multipropiedad, abarcando más de los que el legislador español determina en la Ley de Aprovechamiento por turno de bienes inmuebles de uso turístico y normas tributarias. También se revisan los antecedentes legislativos y prelegislativos, entre ellos especialmente la Directivas de la Unión Europea en la materia. Analizando esta última y sus antecedentes se llega a la conclusión, especialmente en lo que se refiere a principios, que no fue adecuadamente transpuesta a la legislación española. La Ley citada reprime el mercado de la industria y consecuentemente el del turismo, lo que va en contra de permitir la libre circulación de bienes, servicios, personas y capitales en el área Europea. También se analizan la figura jurídica de naturaleza real que fue una de las formulas adoptadas por el legislador español. Se llega a la conclusión de que no responde a un genuino derecho real. Además las razones dadas por el legislador para adoptar esta figura no justifican suficientemente esa posición. Se concluye que bastaba con una legislación que se ocupara exclusivamente, de la protección a los consumidores, sin que fuera necesario determinar una concreta naturaleza jurídica y menos excluyendo otras muchas fórmulas posibles.

Book excerpt: El derecho de aprovechamiento por turnos de bienes turísticos, conocido popularmente como "multipropiedad", ha sido fuente de numerosas quejas, ligadas casi siempre a unas técnicas de venta muy agresivas que no dejan al consumidor tiempo para reflexionar.Con el término de "multipropiedad" se denominan aquellas fórmulas por las que un usuario adquiere el derecho a disfrutar de un alojamiento durante un período determinado cada año sin pagar la entera propiedad del inmueble. Desde el punto de vista jurídico, la figura implica una división temporal del derecho a disfrutar del bien. Sin embargo, en la década de los noventa, ante la ausencia de una normativa adecuada, se produjeron numerosos fraudes. Esto se solucionó con la Ley 42/98, una transposición a nuestra legislación de la Directiva Europea, que entró en vigor a principios de 1999 y que supone una importante protección para el consumidor.El "time-sharing" o derecho de aprovechamiento por turnos de un apartamento es una fórmula legal y válida para disfrutar unas vacaciones. Nació en los países del norte de Europa y se ha extendido a prácticamente todo el continente. El libro incorpora de forma íntegra y actualizada la Ley 4/2012, de 6 de julio, de contratos de aprovechamiento por turno de bienes de uso turístico, de adquisición de productos vacacionales de larga duración, de reventa y de intercambio y normas tributarias.
