Book excerpt: The right to a healthy environment has been the subject of extensive philosophical debates that revolve around the question: Should rights to clean air, water, and soil be entrenched in law? David Boyd answers this by moving beyond theoretical debates to measure the practical effects of enshrining the right in constitutions. His pioneering analysis of 193 constitutions and the laws and court decisions of more than 100 nations in Europe, Latin America, Asia, and Africa reveals a positive correlation between constitutional protection and stronger environmental laws, smaller ecological footprints, superior environmental performance, and improved quality of life.

Book excerpt: This book provides an analysis of the recent governance of the Amazon in Brazil, Peru, Bolivia and Colombia with a particular focus on deforestation processes, demonstrating that current policies and political and socioeconomic dynamics in the four countries are risking the forest’s resilience. The authors examine and compare Amazonian politics and policies under different administrations, concentrating on the main actors, policies and dynamics that have affected the region, as well as on the institutional and political environment in which deforestation processes were embedded in different periods. Essentially, the book makes an analytical contribution towards a better understanding of the political, economic and social challenges confronting conservation policy in the Amazonian countries. Climate Change and Biodiversity Governance in the Amazon: At the Edge of Ecological Collapse? is essential reading for students and researchers in the fields of environmental studies and sustainability, Latin American studies, political science and international relations, as well as for policymakers and practitioners working in conservation and development.

Available in PDF, EPUB and Kindle. Book excerpt: Demonstrating the shortcomings of current policy and legal approaches to access and benefit-sharing (ABS) in the Convention on Biological Diversity (CBD), this book recognizes that genetic resources are widely distributed across countries and that bilateral contracts undermine fairness and equity. The book offers a practical and feasible regulatory alternative to ensure the goal of fairness and equity is effectively and efficiently met. Through a legal analysis that also incorporates historic, economic and sociological perspectives, the book argues that genetic resources are not tangible resources but information. It shows that the existing preference for bilateralism and contracts reflects resistance on the part of many of the stakeholders involved in the CBD process to recognize them as such. ABS issues respond very well to the economics of information, yet as the author explains, these have been either sidelined or overlooked. At a time when the Nagoya Protocol on ABS has renewed interest in feasible policy options, the author provides a constructive and provocative critique. The institutional, policy and regulatory framework constitute "bounded openness" under which fairness and equity emerge.

Available in PDF, EPUB and Kindle. Book excerpt: Great uncertainty typically surrounds decisions and management actions in the conservation of biodiversity and natural resource management, and yet there are risks of serious and irreversible harm for both biodiversity and the humans that rely on it. The precautionary principle arguably underlies all international conservation efforts and promotes acting to avoid serious or irreversible environmental harm, despite lack of scientific certainty as to the likelihood, magnitude or cause of harm. This book is the first to examine the application of the precautionary principle to biodiversity conservation and natural resource management, incorporating perspectives from scientists, economists, lawyers and practitioners from both developing and developed countries. It analyses the application and impacts of the principle in many areas including forestry, invasive alien species, wildlife trade, protected areas and fisheries, in a range of national and international contexts. Particular attention is drawn to issues of equity, livelihoods, science and politics, and the book provides guidelines for applying the precautionary principle to biodiversity conservation and natural resource management.

Available in PDF, EPUB and Kindle. Book excerpt: "For decades, studies of oil-related conflicts focused on the causes and effects of natural resources mismanagement, commonly known as the "resource curse"-the paradoxical connection between oil wealth and economic busts (as in Venezuela) or, in a later twist, the link between the predatory behavior of armed rebel organizations and the abundant natural resources that funded their existence. Patricia Vasquez notes that oil busts and civil wars associated with the resource curse were quite different from the now-predominant local hydrocarbons disputes that are multiplying rapidly in Latin America. These more recent, localized disputes-over land, population displacement, water contamination, oil jobs that are promised but never materialize, etc.-primarily involve Indigenous groups with a different social and cultural identity from the rest of the population. Vasquez spent fifteen years making regular field visits to the oil-producing regions of Latin America and conducting hundreds of interviews with the various stakeholders in these local conflicts. Her book, based on this field research, analyzes the dynamics that characterize each of fifty-five social and environmental conflicts related to oil and gas extraction in the Andean countries (Peru, Ecuador, and Columbia). She is interested not in promulgating a new theory of conflict but in examining the triggers of local hydrocarbons disputes and providing policy recommendations to resolve or prevent them"--

This book was released on 2017-06-27 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: The University of Milan’s SHuS (Interdisciplinary Research Centre for Sustainability and Human Security: Co-operation and Governance agendas) offers a collection of high standard contributions and testimonies of good practice analyzing the complex subjects of access to rights and resources worldwide. This to a world looking to the future and projecting its goals of sustainable development. The thirty three contributors took part in the Milan University sessions of the International Conference dedicated to Land, Water and Resources Rights, organized by the Editor under the auspices of the EU-Joint Research Centre Expo 2015 and the City of Milan Scientific Committee for Expo 2015. With no claims to being exhaustive, the multi-disciplinary approach and the inter-disciplinary perspectives adopted to the topics are enforced by suggestions for political and legal approaches that a regional structure like the EU should be adopting to prevent legitimization leading to severe forms of injustice against communities and individuals. SHuS has chosen open access to this e-book in order to create a seamless connection between scientific communities and the wider civil society. Thus it underscores one of the priorities of the Centre by ensuring the greatest possible impact of much needed multifaceted scientific approaches to society and the problems afflicting it.

It reviews both mandatory provisions and the use of voluntary instruments such as easements and private reserve designations that have grown in use since the early 1990s. It ends with recommendations for an improved framework for private lands conservation, and presents model laws for the creation of private reserves and conservation easements.

Available in PDF, EPUB and Kindle. Book excerpt: This book empirically examines a diverse range of groundwater issues and different approaches to deal with such concerns taking into account responses from government bodies, community organizations, scientists, private sector, and academia. The overarching objective of this book is to empirically examine groundwater governance and groundwater law. It aims to provide a better understanding of the complexities surrounding groundwater governance in order to reconceptualize and retheorize the governance of subterranean resources having as entry points equity and sustainability concerns. This involves understanding what people do when using, sharing, protecting, and measuring groundwater; and why do they do what they do, i.e., what are their motivations to resort to certain practices. This is done through the comparative and contrasting investigation of six case studies from countries from the Global North and Global South. It offers a different perspective of literature given that it explains how groundwater governance and law are in practice rather than what they should be. Additionally, the research presented in this book provides ideas on how to rethink the design and implementation of groundwater law grounded on empirically based descriptions and the understanding of groundwater problems.

Book excerpt: Through 25 peer-reviewed essays, scholars from the United States and Mexico delve into the environmental, social, economic, and cultural-historical components of what we call an environmental and tourism paradise - the region of Los Cabos, Baja California Sur. This region is vulnerable precisely because of the strong development pressure generated mainly by the tourism sector. Los Cabos analyzes these problems as an opportunity to contribute to the sustainable development of the region.
