Book Synopsis The Impact of EU Law on the Regulation of International Air Transportation by : Martin Bartlik
Download or read book The Impact of EU Law on the Regulation of International Air Transportation written by Martin Bartlik and published by Routledge. This book was released on 2016-12-05 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: On 5 November 2002, the European Court of Justice delivered its 'open-skies' judgment, a landmark decision which may be the beginning of a new era in the regulation of international air law. The consequences of this judgment may not only affect the European Union and its Member States; this book shows how it could change the future regulation of international aviation worldwide. The first part of this book describes the difficulties arising from the fact that the competence for the regulation of air transportation in Europe is divided between the EU and the Member States. This division of power will also affect the conclusion of air-service agreements made with countries outside of Europe. In the second part of the book, the author examines a subject that was not part of the 'open-skies' judgment, but which he believes will become a problematic consequence: the distribution of air-traffic rights within the European Union.

Book Synopsis Uniformity of Customs Administration in the European Union by : Kathrin Limbach
Download or read book Uniformity of Customs Administration in the European Union written by Kathrin Limbach and published by Bloomsbury Publishing. This book was released on 2015-11-19 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Uniform customs administration is of great importance for the EU and the competitiveness of EU businesses in global trade. However, the EU's so-called executive federalism raises the potential for the non-uniform application of EU customs law. This problem has already arisen in the European Communities – Selected Customs Matters WTO dispute settlement. Therefore, the central research question of this book concerns the challenge presented to executive federalism in the EU Customs Union by the WTO. It also examines those safeguard measures for uniform customs administration which are in operation. Valuable empirical analysis of the decision-making procedures and practices of the national customs authorities allows for the fullest understanding of the operation of the customs administration. An important feature of the exploration is its analysis of the reform of EU customs law and of the effectiveness of the European Union's strategies to enhance uniform customs administration. That analysis helps to identify potential weak points in the decentralised administration of EU customs law and suggests ways in which it might be improved. Scholarly, rigorous and timely, this important study will be required reading for all scholars of EU customs law.
Book Synopsis Procedural Autonomy of EU Member States: Paradise Lost? by : Diana-Urania Galetta
Download or read book Procedural Autonomy of EU Member States: Paradise Lost? written by Diana-Urania Galetta and published by Springer Science & Business Media. This book was released on 2010-07-23 with total page 160 pages. Available in PDF, EPUB and Kindle. Book excerpt: Is the procedural autonomy of EU Member State a myth or a reality? What should this concept be taken to mean? Starting from the analysis of requirements and principles regulating, generally speaking, the relationships between Member States’ and EU law, this book provides a definition of procedural autonomy able to account for the concept’s inherent limits. Out of an analysis of the more relevant EU jurisprudence, the author identifies the rationale underlying the interventions of the ECJ on issues of procedural autonomy and the common logic that emerges from it; and reveals how, in an unchanged context of ‘procedural autonomy’ of the Member States, national procedural law becomes more and more ‘functionalized’ to the requirements of effectiveness of substantive EU law. As such, we should speak of a ‘functionalized procedural competence’ rather than of procedural autonomy. But this is by no means a case of “Paradise Lost.” The book includes a foreword by Prof. Jürgen Schwarze, one of the founding fathers of European Administrative Law.

Download or read book Die Rechtsstellung des Menschen im Völkerrecht written by Thilo Marauhn and published by Mohr Siebeck. This book was released on 2003 with total page 144 pages. Available in PDF, EPUB and Kindle. Book excerpt: English summary: The individual has long been seen as being only a part of the state, which is the primary subject of public international law. Recently, however, it has become a generally accepted fact that the individual has international rights and obligations, which means that he has at least limited legal capacity. This volume reflects recent tendencies in this dynamic field and provides perspectives for further development.
